UNOFFICIAL COPY 22 RS BR 994 Page 1 of 3 XXXX Jacketed AN ACT relating to the Prosecutors Advisory Council. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 ď˘Section 1. KRS 15.705 is amended to read as follows: 3 (1) For the purpose of administration of the unified prosecutorial system, there is 4 hereby created the Prosecutors Advisory Council, hereafter referred to as the 5 council. 6 (2) The council shall consist of thirteen (13)[nine (9)] members who shall be residents 7 of Kentucky and shall include: 8 (a) The Attorney General or his or her designee; 9 (b) Five (5)[three (3)] Commonwealth's attorneys:[,] 10 1. One (1) from a county[counties] containing a consolidated local 11 government, a county[city] with a population of one hundred thirty 12 thousand (130,000)[twenty thousand (20,000)] or more based on the 13 most recent federal decennial census, or an urban-county government;[,] 14 2. One (1) from a county[counties containing a city] with a population 15 equal to or greater than fifty thousand (50,000)[eight thousand (8,000)] 16 but less than one hundred thirty thousand (130,000)[twenty thousand 17 (20,000)] based on the most recent federal decennial census;[, and] 18 3. One (1) from a county with a population equal to or greater than 19 twenty five thousand (25,000) but less than fifty thousand (50,000) 20 based on the most recent federal decennial census;[the other counties,] 21 4. One (1) from a county with a population equal to or greater than 22 twelve thousand (12,000) but less than twenty five thousand (25,000) 23 based on the most recent federal decennial census; and 24 5. One (1) from a county with a population less than twelve thousand 25 (12,000) based on the most recent federal decennial census; 26 Each of whom shall be elected by the membership of[appointed by the 27 UNOFFICIAL COPY 22 RS BR 994 Page 2 of 3 XXXX Jacketed Governor from a list of three (3) names for each Commonwealth's attorney 1 position submitted by] the Commonwealth's Attorneys Association;[ and] 2 (c) Five (5)[three (3)] county attorneys:[,] 3 1. One (1) from a county[counties] containing a consolidated local 4 government, a county[city] with a population equal to or greater than 5 one hundred thirty thousand (130,000)[twenty thousand (20,000)] 6 based on the most recent federal decennial census, or an urban-county 7 government;[,] 8 2. One (1) from a county[counties containing a city] with a population 9 equal to or greater than fifty thousand (50,000)[eight thousand (8,000)] 10 but less than one hundred thirty thousand (130,000) [twenty thousand 11 (20,000)] based on the most recent federal decennial census[, and] 12 3. One (1) from a county with a population equal to or greater than 13 twenty five thousand (25,000) but less than fifty thousand (50,000) 14 based on the most recent federal decennial census;[the other counties,] 15 4. One (1) from a county with a population equal to or greater than 16 twelve thousand (12,000) but less than twenty five thousand (25,000) 17 based on the most recent federal decennial census; and 18 5. One (1) from a county with a population less than twelve thousand 19 (12,000) based on the most recent federal decennial census; 20 Each of whom shall be elected by the membership of[appointed by the 21 Governor from a list of three (3) names for each county attorney position 22 submitted by] the County Attorneys Association; and 23 (d) Two (2) nonattorney citizen members: 24 1. One (1) appointed by the Attorney General from a list of three (3) 25 names submitted by the Commonwealth's Attorneys Association; and 26 2. One (1) appointed by the Attorney General from a list of three (3) 27 UNOFFICIAL COPY 22 RS BR 994 Page 3 of 3 XXXX Jacketed names submitted by the County Attorneys Association. 1 The Attorney General shall serve during his term of office and the other members 2 shall serve for a term of two (2) years[at the pleasure of the Governor]. A 3 Commonwealth's attorney or a county attorney shall not serve more than one (1) 4 consecutive term. 5 (3) The Attorney General shall be the chair[chairman] of the council. Seven (7)[Five 6 (5)] members shall constitute a quorum for the conduct of business. The council 7 shall promulgate annually a schedule of meetings. Special meetings may be called 8 by the chair[chairman] or seven (7)[five (5)] members of the council. A minimum 9 of ten (10) days' notice must be given prior to the call of a special meeting. Such a 10 notice may be waived by a majority of the council. 11 (4) The council shall be responsible for, but not limited to, the preparation of the 12 budget of the unified prosecutorial system of the Commonwealth of Kentucky and 13 the continuing legal education and program development of the unified 14 prosecutorial system of Kentucky. 15 (5) Each nonattorney citizen member of the council shall receive twenty-five dollars 16 ($25) per day for attending each meeting. All council members shall be reimbursed 17 for actual expenses incurred in the performance of their duties. 18
