A CONCURRENT RESOLUTION urging the President of the United States to 1 
issue an executive order to remove the federally mandated reformulated gasoline 2 
requirements for all affected areas nationwide, including Jefferson County and parts of 3 
Bullitt and Oldham Counties, for the remainder of 2022. 4 
WHEREAS, pursuant to the federal Clean Air Act (Act) as amended, 42 U.S.C. 5 
secs. 7401 et seq., the Commonwealth of Kentucky is required to prepare and submit to 6 
the Environmental Protection Agency (EPA) a state implementation plan and revisions to 7 
such plan as appropriate to attain and maintain the National Ambient Air Quality 8 
Standards (NAAQS) and protect human health; and 9 
WHEREAS, pursuant to KRS Chapter 224, the Energy and Environment Cabinet 10 
(cabinet) is designated as the air pollution control agency of this Commonwealth for all 11 
purposes of the Act; and 12 
WHEREAS, pursuant to KRS Chapter 77, the air pollution control district (district) 13 
is authorized to control air pollution in Jefferson County; and 14 
WHEREAS, the Kentucky Air Pollution Control Commission granted concurrent 15 
jurisdiction to the district on January 26, 1971; and  16 
WHEREAS, the intent of the cabinet and the district is to operate an effective air 17 
pollution control program in Jefferson County as authorized under KRS Chapters 77 and 18 
224 through joint implementation of necessary control strategies; and 19 
WHEREAS, Governor Brereton Jones, through a letter dated September 29, 1993, 20 
opted into the federal reformulated gasoline requirements effective January 1, 1995; and 21 
WHEREAS, the EPA mandated improved quality in conventional gasoline 22 
beginning in 2011; and 23 
WHEREAS, consequently, the environmental benefits of reformulated gasoline 24 
compared to conventional gasoline no longer provide as significant of an environmental 25 
benefit as in the past; and 26 
WHEREAS, last year, reformulated gas was consistently 30 to 35 cents more 27  UNOFFICIAL COPY  	22 RS HCR 124/GA

expensive than conventional gas. In mid-October, reformulated gasoline was about 46 1 
cents more expensive than conventional gasoline; and 2 
WHEREAS, the national average price of gasoline is currently at a historic level of 3 
$4.32 per gallon. There are fears that there is no end in sight as the current United States 4 
inflation rate is at 7.5%, the highest since 1982; 5 
NOW, THEREFORE, 6 
Be it resolved by the House of Representatives of the General Assembly of the 7 
Commonwealth of Kentucky, the Senate concurring therein: 8 
Section 1.   The General Assembly hereby urges President Joseph R. Biden, Jr., 9 
through executive order and for the remainder of the calendar year, to remove the 10 
federally mandated reformulated gasoline requirements not only for Jefferson County and 11 
parts of Bullitt and Oldham Counties, but for citizens nationwide. 12 
Section 2.   The Clerk of the House of Representatives is directed to transmit 13 
copies of this Resolution to: the Honorable Joseph R. Biden, Jr., President of the United 14 
States, 1600 Pennsylvania Avenue NW, Washington, D.C. 20500; Michael S. Regan, 15 
Administrator, Environmental Protection Agency, 1101A, 1200 Pennsylvania Avenue, 16 
N.W.,Washington, DC 20460; and each member of the Kentucky congressional 17 
delegation. 18
