AN ACT relating to transportation. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
Section 1.   KRS 177.074 is amended to read as follows: 3 
(1) Every road which is part of the state primary system shall be identified by a specific 4 
route number[ or name which shall be designated on the official state road map]. In 5 
addition to a route number, the secretary[: 6 
(a) ]shall direct the placement of signage denoting the honorary naming of a 7 
bridge,[ name] a road, or a road segment to comply with the provisions of 8 
subsections (2), (3), and (5)[(3)] of this section[; and 9 
(b) May, at the secretary's discretion, or subject to the provisions of subsection (4) 10 
of this section, name a road or bridge on the state highway system after an 11 
individual, historic event, or any other name which may be of significance to 12 
the history of this Commonwealth or any of its counties or communities]. 13 
(2) The secretary shall, within thirty (30) days of receipt of a written request by the 14 
commissioner of the Department of Kentucky State Police, name a state road or 15 
segment of a state road in memory and honor of[ one (1) or more] Kentucky state 16 
troopers killed in the line of duty. The written request shall [comply with the 17 
provisions of subsection (4) of this section and shall ]include the: 18 
(a) [The ]Trooper's name; 19 
(b) [The name and address of any living relatives of the trooper, if known; 20 
(c) ]Date and circumstances of the trooper's death; and 21 
(c)[(d) The route number and current name of the state road where the trooper 22 
was killed, if applicable, or the route number and current name of the state 23 
road closest to the deceased trooper's home. 24 
(3) The written request required under subsection (2) of this section shall identify 25 
the route number, current name of the state road, or milepoints of the ]Specific 26

requesting be named in honor and memory of the[a] state trooper killed in the 1 
line of duty.[ ] 2 
(3) The road or road segment identified in the request shall be either the state road 3 
where the trooper was killed, or the state road closest to the deceased trooper's 4 
home. The cabinet shall consult with the commissioner of the Department of 5 
Kentucky State Police on the design and installation of the road signs naming the 6 
state road or road segment in honor and memory of each trooper, and the cabinet 7 
shall erect the appropriate highway signs within thirty (30) days of receipt of the 8 
written request required under subsection (2) of this section. 9 
(4) If the road segment identified in the request under subsection (2) of this section has 10 
already been named for another individual or organization,[ either by action of the 11 
General Assembly or by order of the secretary,] the Department of Kentucky State 12 
Police and the cabinet shall consult on and determine an alternate location that is 13 
acceptable to both agencies. 14 
(5) [The secretary shall be petitioned by a unit of local government, civic organization, 15 
or other interested party before naming a road or bridge on the state primary road 16 
system. In addition, the secretary shall be convinced by the petitioner that the person 17 
or event that the road or bridge is being named for is of civic or historical 18 
significance. 19 
(6) Except as provided in subsections (9) and (10) of this section, ]The secretary shall 20 
direct the placement of signage denoting the honorary naming of [name ]a road, a 21 
road segment, or a bridge upon direction by joint resolution of the General 22 
Assembly[. Upon introduction of a resolution, the secretary shall inform the 23 
chairman of the committee to which the resolution is assigned as to whether he or 24 
she has been petitioned to name a road or bridge presented in the resolution and if 25 
so petitioned, his or her reasons for not taking action on the request]. 26

the signs to be placed on the roads shall become the responsibility of the petitioner 1 
with the design and placement of the signs approved by the department. ]The 2 
placement of[If] the signs installed [are to be placed ]as a result of a resolution 3 
passed by the General Assembly shall be[,] the responsibility [for placement ]of[ 4 
the signs shall be upon] the Department of Highways. 5 
(7) (a) A school board or the governing body of a city or county may petition the 6 
secretary for the installation of temporary signage honoring an individual, 7 
a group of individuals, or a team. 8 
(b) The secretary shall, within thirty (30) days of receipt of a written request 9 
under this subsection, approve or deny the petition. 10 
(c) Within thirty (30) days of the approval of a petition, the secretary shall 11 
direct the placement of honorary signage under this subsection. The 12 
Transportation Cabinet shall be the final arbiter of the location of signage 13 
placement under this subsection. Signage installed under this subsection 14 
shall remain in place for a minimum of one (1) year from the date of its 15 
placement. 16 
(d) The petitioning body shall bear all costs of signage and installation under 17 
this subsection. 18 
(8) The Transportation Cabinet may adopt administrative regulations to implement the 19 
provisions of subsection (7) of this section, including but not limited to[road and 20 
bridge naming program. The administrative regulations shall at a minimum 21 
establish] basic standards for design and placement of signs and establishing a 22 
process to[or] allow the petitioning body[local entity] to reimburse the 23 
Transportation Cabinet for the cost of manufacturing and installing the signs for 24 
which a petition has been granted. 25 
(9) The new proposed truck bypass around Mayfield, Kentucky, shall be named the 26 
"Dick Castleman Bypass," after former State Representative Dick Castleman. 27  UNOFFICIAL COPY  	22 RS SB 119/VO

(10) The bridge on United States Highway 27 over the Kentucky River near Camp 1 
Nelson, between Jessamine and Garrard Counties, shall be named the "Loyd 2 
Murphy Memorial Bridge." 3 
Section 2.   KRS 183.8621 is amended to read as follows: 4 
(1) The cabinet shall assign an employee to serve as[Upon recommendation of an 5 
individual by the secretary, the commission shall appoint an] administrator of the 6 
commission. The administrator shall be an employee of the Department of 7 
Aviation. 8 
(2) In addition to commission administration responsibilities, the administrator[who] 9 
shall[ have immediate supervision of the employees of the commission and] 10 
perform such duties as are assigned [him]by the Department of Aviation. 11 
(3) The administrator shall be an individual familiar with aeronautics and the 12 
commission policy, and[. He] shall keep and be custodian of the records and 13 
airport zoning maps adopted by the commission[, and shall devote his full time to 14 
the duties of his office]. 15 
Section 3.   KRS 174.020 is amended to read as follows: 16 
(1) The Transportation Cabinet shall consist of the following major organizational 17 
units: 18 
(a) The Office of the Secretary, which shall include, but not be limited to: 19 
1. The secretary to be appointed by the Governor under KRS 12.255; and 20 
2. The deputy secretary appointed under KRS 12.040; 21 
(b) The Department of Highways, headed by a commissioner, appointed by the 22 
Governor under KRS 12.040; 23 
(c) The Department of Vehicle Regulation, headed by a commissioner, appointed 24 
by the Governor under KRS 12.040. The Motor Vehicle Commission 25 
established in KRS 190.058 shall be attached to the Department of Vehicle 26

(d) The Department of Rural and Municipal Aid, headed by a commissioner 1 
appointed by the Governor under KRS 12.040; 2 
(e) The Department of Aviation, headed by a commissioner appointed by the 3 
Governor under KRS 12.040. The Kentucky Airport Zoning Commission 4 
established by KRS 183.861 shall be attached to the Department of Aviation[ 5 
for administrative purposes]; 6 
(f) The Office of Support Services, headed by an executive director appointed 7 
under KRS 12.040; 8 
(g) The Office of Transportation Delivery, headed by an executive director 9 
appointed under KRS 12.040; 10 
(h) The Office of Audits, headed by an executive director appointed under KRS 11 
12.040; 12 
(i) The Office of Human Resource Management, headed by an executive director 13 
appointed under KRS 12.040; 14 
(j) The Office of Information Technology, headed by an executive director 15 
appointed under KRS 12.040; 16 
(k) The Office of Legal Services, headed by an executive director appointed under 17 
KRS 12.040; 18 
(l) The following offices, which shall be attached to the Office of the Secretary: 19 
1. The Office of Public Affairs, headed by an executive director appointed 20 
under KRS 12.040; 21 
2. The Office of Budget and Fiscal Management, headed by an executive 22 
director appointed under KRS 12.040; 23 
3. The Office for Civil Rights and Small Business Development, headed by 24 
an executive director appointed under KRS 12.040; 25 
4. The Office of Inspector General, headed by an executive director 26

5. The Secretary's Office of Safety, headed by an executive director 1 
appointed under KRS 12.040; 2 
(m) The following offices, which shall be attached to the Department of 3 
Highways: 4 
1. The Office of Project Development, headed by an executive director 5 
appointed under KRS 12.040, who shall be a registered professional 6 
engineer under KRS Chapter 322, and who shall be known as the deputy 7 
state highway engineer for project development; 8 
2. The Office of Project Delivery and Preservation, headed by an executive 9 
director appointed under KRS 12.040, who shall be a registered 10 
professional engineer under KRS Chapter 322, and who shall be known 11 
as the deputy state highway engineer for project delivery and 12 
preservation; 13 
3. The Office of Highway Safety, headed by an executive director 14 
appointed under KRS 12.040; and 15 
4. Highway District Offices One through Twelve, each district office to be 16 
headed by an executive director, also known as the chief district 17 
engineer, appointed under KRS 12.040, who shall be a registered 18 
professional engineer under KRS Chapter 322; and 19 
(n) The following offices, which shall be attached to the Department of Rural and 20 
Municipal Aid: 21 
1. Office of Local Programs, headed by an executive director appointed 22 
under KRS 12.040; and 23 
2. Office of Rural and Secondary Roads, headed by an executive director 24 
appointed under KRS 12.040. 25 
(2) The position of director in the Division of Environmental Analysis is a policy-26

Section 4.   KRS 183.140 is amended to read as follows: 1 
(1)[ The Transportation Cabinet is authorized to establish in cooperation with airport 2 
boards, established pursuant to KRS 183.132 through 183.138, a pilot 3 
demonstration air service project for the purpose of developing air services on a 4 
regularly scheduled basis for the movement of passengers, mail and cargo by a 5 
commuter air carrier between five (5) or more airport termini in the Commonwealth 6 
of Kentucky at least one of which does not receive service from a carrier certificated 7 
by the civil aeronautics board, in the public interest of convenience and necessity 8 
for air transportation. 9 
(2)] The Transportation Cabinet may reimburse any airport board for direct financial aid, 10 
or benefits and services in lieu thereof, which the airport board has expended for the 11 
development of commuter air carrier services that provide regularly scheduled 12 
passenger, mail and cargo service or any combination thereof to the airport terminus 13 
operated by the airport board. 14 
(2)[(3)] Any airport board established pursuant to KRS 183.132 through 183.138 is 15 
authorized to provide direct financial aid, or benefits and services in lieu thereof, to 16 
commuter air carriers that provide regularly scheduled passenger, mail, and cargo 17 
service or any combination thereof to their community. 18 
Section 5.   KRS 183.475 is amended to read as follows: 19 
All counties in this state located on the boundary line between this state and any other 20 
state, or which are contiguous to such counties, as well as all governmental units which 21 
are located in such boundary counties, or contiguous counties, are[ hereby] authorized, 22 
separately, jointly with each other, or jointly with any other municipality or political 23 
subdivision of any[ such] boundary state, to acquire, equip, construct, expand, lease, 24 
improve, police and operate airports within this state or either within or without the 25 
geographical limits of any county, municipality or political subdivision of any[ such] 26 
boundary state; and for those purposes to exercise any other powers or functions and be 27  UNOFFICIAL COPY  	22 RS SB 119/VO

subject to any provisions provided by KRS Chapter 183 as to aviation, without regard to 1 
any express or implied limitations[ thereof] to or within this state[, including but not 2 
limited to those provided by KRS 183.010 through 183.012, "Definitions," KRS 183.132 3 
through 183.138, "Local Air Boards," KRS 183.475 through 183.490, "Acquisition of 4 
Airport Facilities," KRS 183.630 through 183.740, "Bonds," KRS 183.762 through 5 
183.772, "Airport Development," and any amendments or supplements thereto which may 6 
be provided therein subsequent to this amendment]. 7 
Section 6.   The following KRS sections are repealed: 8 
183.032  Adjudicatory powers and proceedings. 9 
183.050  Federal licensing and registration requirement for pilots and aircraft. 10 
183.070  State licensing and registration requirement. 11 
183.203  Applications for assistance -- Airport loan committee, functions. 12 
183.207  Eligibility for loan. 13 
183.210  Loan terms -- Security. 14 
183.213  Regulations. 15 
183.490  Condemnation for privately owned airports. 16
