UNOFFICIAL COPY 22 RS BR 827 Page 1 of 1 XXXX Jacketed AN ACT relating to firearms. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 237 IS CREATED TO 3 READ AS FOLLOWS: 4 (1) As used in this section, "antique firearm" means any firearm, including any 5 firearm with a matchlock, flintlock, percussion cap, or similar type of ignition 6 system, manufactured on or before December 31, 1898. 7 (2) A person who lawfully possesses a firearm shall report the loss or theft of the 8 firearm to any local law enforcement agency or the Department of State Police 9 within forty-eight (48) hours after such person discovers the loss or theft, or is 10 informed by a person with personal knowledge of the loss or theft. 11 (3) The law enforcement agency that receives a report pursuant to subsection (2) of 12 this section shall enter the reported information into the National Crime 13 Information Center maintained by the Federal Bureau of Investigation. 14 (4) (a) A violation of subsection (2) of this section is punishable by a civil penalty 15 not to exceed two hundred fifty dollars ($250). 16 (b) The county attorney for the county in which an alleged violation of 17 subsection (2) of this section has occurred is authorized to enforce the 18 provisions of this section and may bring an action to recover the civil 19 penalty. 20 (5) No person who, in good faith, reports a lost or stolen firearm shall be held 21 criminally or civilly liable for any damages from acts or omissions resulting from 22 the loss or theft. This subsection shall not apply to any person who makes a 23 report in violation of KRS 519.040. 24 (6) The provisions of subsection (2) of this section shall not apply to the loss or theft 25 of an antique firearm. 26
