UNOFFICIAL COPY 22 RS BR 1930 Page 1 of 2 XXXX Jacketed AN ACT relating to registered sex offender information. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 SECTION 1. A NEW SECTION OF KRS 194A.700 TO 194A.729 IS 3 CREATED TO READ AS FOLLOWS: 4 An assisted-living community shall ensure that every client or prospective client, the 5 client's responsible party, or the client's legal guardian is: 6 (1) Fully informed, as evidenced by written acknowledgment, that he or she should 7 exercise whatever due diligence deemed necessary with respect to information on 8 any sex offender registered pursuant to KRS 17.500 to 17.580; 9 (2) Provided with instructions on how to access the registered sex offender 10 information; 11 (3) Upon request, assisted with accessing the registered sex offender information; 12 and 13 (4) Upon request, provided with printed copies of the requested information. 14 Section 2. KRS 216.520 is amended to read as follows: 15 For the purpose of supplementing the rights of residents in long-term[-] care facilities, 16 every long-term care facility shall[such facilities shall take the following actions]: 17 (1) [Every long-term-care facility shall ]Conspicuously post throughout the facility a 18 listing of the residents' rights and responsibilities as defined in KRS 216.515 to 19 216.525;[.] 20 (2) [Every long-term-care facility shall ]Develop and implement a mechanism which 21 will allow each resident and the responsible party or his or her responsible family 22 member or his or her guardian to participate in the planning of the resident's care. 23 Each resident shall be encouraged and provided assistance in the planning of his or 24 her care;[.] 25 (3) [All long-term-care facilities shall ]Establish written procedures for the submission 26 and resolution of complaints and recommendations by the resident and the 27 UNOFFICIAL COPY 22 RS BR 1930 Page 2 of 2 XXXX Jacketed responsible party, [or ]his or her responsible family member, or his or her guardian. 1 Such policies shall be conspicuously displayed throughout the facility pending 2 approval of their adequacy by the cabinet;[.] 3 (4) [Every long-term-care facility shall ]Prepare a written plan and provide appropriate 4 staff training to implement each of the residents' rights as defined in KRS 216.515 5 to 216.525;[.] 6 (5) [All long-term-care facilities shall ]Maintain in their facilities one (1) copy of the 7 most recent inspection report as prepared by the Cabinet for Health and Family 8 Services. The cabinet shall provide all long-term[-] care facilities with one (1) copy 9 of the most recent inspection report; and 10 (6) Ensure that every resident or prospective resident, the resident's responsible 11 party, or the resident's legal guardian is: 12 (a) Fully informed, as evidenced by written acknowledgment, that whatever due 13 diligence deemed necessary should be taken with respect to information on 14 any sex offender registered pursuant to KRS 17.500 to 17.580; 15 (b) Provided with instructions on how to access the registered sex offender 16 information; 17 (c) Upon request, assisted with accessing the registered sex offender 18 information; and 19 (d) Upon request, provided with printed copies of the requested information. 20
