UNOFFICIAL COPY 22 RS BR 1372 Page 1 of 2 XXXX Jacketed AN ACT relating to superintendent screening committees. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 ď˘Section 1. KRS 160.352 is amended to read as follows: 3 (1) For purposes of this section the term "minority" means American Indian; Alaskan 4 native; African-American; Hispanic, including persons of Mexican, Puerto Rican, 5 Cuban, and Central or South American origin; Pacific islander; or other ethnic 6 group underrepresented in a local school district. 7 (2) Each board of education shall appoint a superintendent of schools after receiving 8 the recommendations of a screening committee. A screening committee shall be 9 established within thirty (30) days of a determination by a board of education that a 10 vacancy has occurred or will occur in the office of superintendent, except that when 11 the board determines a vacancy will not occur before six (6) months from the date 12 of determination, the board shall establish a screening committee at least ninety (90) 13 days before the first date on which the position may be filled. 14 (3) Except as provided in subsection (4) of this section, a screening committee shall be 15 composed of: 16 (a) Two (2) teachers, elected by the teachers in the district; 17 (b) One (1) board of education member, appointed by the board chairman; 18 (c) One (1) principal, elected by the principals in the district; 19 (d) One (1) parent who is not employed by the school district, elected by the 20 presidents of the parent-teacher organizations of the schools in the district; 21 (e) One (1) classified employee, elected by the classified employees in the 22 district; and 23 (f) If a minority member is not elected or appointed to a screening committee in 24 districts with a student minority population of eight percent (8%) or more, as 25 determined by the enrollment on the preceding October 1, the committee 26 membership shall be increased to include one (1) minority parent. Parents in the district shall be given 2 adequate notice of the date, time, place, and purpose of the election. 3 (4) For a school district with a student minority population of fifty percent (50%) or 4 greater, a screening committee shall be composed of: 5 (a) Three (3) teachers, at least one (1) of whom shall be a member of a minority 6 group, elected by the teachers employed in the district; 7 (b) One (1) board of education member, appointed by the board chairman; 8 (c) Two (2) principals, at least one (1) of whom shall be a member of a minority 9 group, elected by the principals of schools in the district; 10 (d) Two (2) parents who are not employed by the school district, at least one (1) 11 of whom shall be a member of a minority group, elected by the presidents of 12 the parent-teacher organizations of the schools in the district; 13 (e) Two (2) classified employees, at least one (1) of whom shall be a member of 14 a minority group, elected by the classified employees in the district; and 15 (f) If a minority principal representative is not available, an administrator as 16 defined in KRS 161.720 who is a member of a minority group shall be 17 elected by the administrators in the district. 18 (5) Prior to appointing a superintendent of schools, the board of education shall 19 consider the recommendations of the screening committee, but the board shall not 20 be required to appoint a superintendent from the committee's recommendations. 21
