UNOFFICIAL COPY 23 RS BR 1293 Page 1 of 3 XXXX 2/13/2023 2:58 PM Jacketed AN ACT relating to accreditation requirements for licensure as a professional 1 engineer. 2 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 3 ď˘Section 1. KRS 322.040 is amended to read as follows: 4 (1) A person shall qualify for licensure as a professional engineer by meeting the 5 requirements set forth in paragraph (a) or (b) of this subsection. 6 (a) A person shall qualify if he or she has: 7 1. Graduated from an engineering program of four (4) years or more 8 accredited by the Engineering Accreditation Commission or the 9 Engineering Technology Accreditation Commission of the 10 Accreditation Board for Engineering and Technology or any engineering 11 program deemed equivalent by the board; 12 2. Four (4) or more additional years of progressive experience in 13 engineering or teaching of a grade and character which indicates to the 14 board that the applicant is competent to practice engineering; and 15 3. A passing score on: 16 a. The Principles and Practice of Engineering Examination; and 17 b. The Fundamentals of Engineering Examination. The board may 18 allow students enrolled in the final year of an undergraduate 19 engineering program to take this examination. Upon passing the 20 examination, the applicant shall be designated an engineer in 21 training. 22 (b) If an instructor in an engineering program accredited by the Engineering 23 Accreditation Commission or the Engineering Technology Accreditation 24 Commission of the Accreditation Board for Engineering and Technology or 25 an engineering program deemed equivalent by the board is not eligible for the 26 exemption under subsection (2) of this section, the instructor shall have four 27 UNOFFICIAL COPY 23 RS BR 1293 Page 2 of 3 XXXX 2/13/2023 2:58 PM Jacketed (4) years from the date of hire to qualify for licensure by showing that he or 1 she has: 2 1. Graduated from an engineering program of four (4) years or more 3 accredited by the Engineering Accreditation Commission or the 4 Engineering Technology Accreditation Commission of the 5 Accreditation Board for Engineering and Technology, or an engineering 6 program deemed equivalent by the board; 7 2. Four (4) or more additional years of progressive experience in 8 engineering or teaching of a grade and character which indicates to the 9 board that the applicant is competent to practice engineering; 10 3. Passed the Principles and Practice of Engineering Examination; and 11 4. Either passed the Fundamentals of Engineering Examination or 12 graduated from a board-approved doctoral engineering degree program. 13 (2) For the purpose of teaching engineering design courses only, an instructor who, on 14 January 1, 1999, holds a tenured or tenure-track position in an engineering program 15 defined in KRS 322.010(4)(a)3. shall be exempt from the licensure requirements of 16 KRS 322.020 for the period that instructor is continuously employed by the 17 institution offering that program. However, an instructor may apply and shall 18 qualify for licensure as a professional engineer during this exempt period if he or 19 she: 20 (a) Has graduated from an engineering program of four (4) years or more 21 accredited by the Engineering Accreditation Commission or the Engineering 22 Technology Accreditation Commission of the Accreditation Board for 23 Engineering and Technology or an engineering program deemed equivalent 24 by the board; 25 (b) Has graduated from a board-approved doctoral engineering degree program, 26 with an additional three (3) years or more of progressive experience in 27 UNOFFICIAL COPY 23 RS BR 1293 Page 3 of 3 XXXX 2/13/2023 2:58 PM Jacketed engineering or teaching of a grade and character which indicate to the board 1 that the applicant is competent to practice engineering; and 2 (c) Has passed the Principles and Practice of Engineering Examination. 3 (3) Any person having the necessary qualifications prescribed in subsection (1) or (2) 4 of this section shall be eligible to apply for licensure, even if the applicant is not 5 practicing the profession at the time of application. 6 (4) The board shall promulgate administrative regulations to establish requirements for 7 consideration of experience gained prior to graduation from an engineering program 8 as described in subsection (1)(a)1. of this section. 9
