UNOFFICIAL COPY 23 RS HB 553/EN Page 1 of 8 HB055320.100 - 1266 - XXXX 3/30/2023 9:19 PM Engrossed AN ACT relating to fiscal matters, making an appropriation therefor, and declaring 1 an emergency. 2 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 3 Section 1. 2022 Kentucky Acts Chapter 162, Part II, Capital Projects Budget, 4 (4) Deferred Funding, at page 982, is amended to read as follows: 5 (4) Deferred Funding: (a) General Fund support to provide operating costs 6 of $204,200, use allowance of $1,449,800 and nonrecurring furniture and equipment 7 costs of $500,000 for the Leslie County project is deferred to the 2024-2026 fiscal 8 biennium. 9 (b) General Fund support to provide operating costs totaling $234,000, use 10 allowance payments totaling $1,682,000 and nonrecurring furniture and equipment costs 11 totaling $750,000 for the Graves County project is deferred to the 2024-2026 fiscal 12 biennium. 13 (c) General Fund support to provide operating costs totaling $2,053,500 and 14 nonrecurring furniture and equipment costs of $3,575,000 for six judicial center projects 15 authorized by the 2020 General Assembly is deferred to the 2024-2026 fiscal biennium. 16 (d) It is the intent of the General Assembly that all projects in paragraphs (a), (b), 17 and (c) of this subsection shall be funded using resources previously appropriated for 18 projects that no longer require use allowance debt payments in the 2024-2026 fiscal 19 biennium. 20 (e) General Fund support to provide additional annualized use allowance 21 payments totaling $50,600 attributable to a project scope increase for the Bath County 22 facility project authorized by the 2018 General Assembly and based on $575 per square 23 foot is deferred to the 2024-2026 fiscal biennium. 24 (f) General Fund support to provide additional annualized use allowance 25 payments totaling $251,200 attributable to a project scope increase for the Barren 26 County facility project authorized by the 2020 General Assembly and based on $610 27 UNOFFICIAL COPY 23 RS HB 553/EN Page 2 of 8 HB055320.100 - 1266 - XXXX 3/30/2023 9:19 PM Engrossed per square foot is deferred to the 2024-2026 fiscal biennium. 1 (g) General Fund support to provide additional annualized use allowance 2 payments totaling $63,500 attributable to a project scope increase for the Butler 3 County facility project authorized by the 2020 General Assembly and based on $610 4 per square foot is deferred to the 2024-2026 fiscal biennium. 5 (h) General Fund support to provide additional annualized use allowance 6 payments totaling $64,100 attributable to a project scope increase for the Clinton 7 County facility project authorized by the 2020 General Assembly and based on $610 8 per square foot is deferred to the 2024-2026 fiscal biennium. 9 (i) General Fund support to provide additional annualized use allowance 10 payments totaling $105,200 attributable to a project scope increase for the Crittenden 11 County facility project authorized by the 2020 General Assembly and based on $575 12 per square foot is deferred to the 2024-2026 fiscal biennium. 13 (j) General Fund support to provide additional annualized use allowance 14 payments totaling $790,800 attributable to a project scope increase for the Jessamine 15 County facility project authorized by the 2020 General Assembly and based on $575 16 per square foot is deferred to the 2024-2026 fiscal biennium. 17 (k) General Fund support to provide additional annualized use allowance 18 payments totaling $278,400 attributable to a project scope increase for the Scott County 19 facility project authorized by the 2020 General Assembly and based on $575 per square 20 foot is deferred to the 2024-2026 fiscal biennium. 21 (l) General Fund support to provide additional annualized use allowance 22 payments totaling $288,400 attributable to a project scope increase for the Madison 23 County facility project authorized by the 2021 General Assembly and based on $500 24 per square foot is deferred to the 2024-2026 fiscal biennium. 25 (m) General Fund support to provide additional annualized use allowance 26 payments totaling $97,000 attributable to a project scope increase for the Graves 27 UNOFFICIAL COPY 23 RS HB 553/EN Page 3 of 8 HB055320.100 - 1266 - XXXX 3/30/2023 9:19 PM Engrossed County facility project authorized by the 2022 General Assembly and based on $610 1 per square foot is deferred to the 2024-2026 fiscal biennium. 2 (n) General Fund support to provide additional annualized use allowance 3 payments totaling $101,200 attributable to a project scope increase for the Leslie 4 County facility project authorized by the 2022 General Assembly and based on $610 5 per square foot is deferred to the 2024-2026 fiscal biennium. 6 Section 2. 2022 Kentucky Acts Chapter 162, Part II, Capital Projects Budget, 7 A. Judicial Branch, 2. Local Facilities Fund, 004. Hardin County – HVAC Project, at 8 page 983, is amended to read as follows: 9 004. Hardin County - HVAC Project 10 General Fund 3,000,000 -0- 11 (1) Hardin County - HVAC Project Scope and Authority: The fiscal year 2022-12 2023 project scope for the Hardin County - HVAC Project shall be no more than 13 $6,000,000, of which General Fund moneys in the amount of $3,000,000 are 14 appropriated above. Any increase in project scope above $3,000,000 shall not constitute 15 additional General Fund appropriations. 16 (2) Facility Title: Pursuant to KRS Chapter 26A, Hardin County shall accept 17 title to the facility within six months of notification by the Administrative Office of the 18 Courts of the completion of the project. 19 Section 3. 2022 Kentucky Acts Chapter 199, Part I, Operating Budget, A. 20 General Government, 9. Department for Local Government, (10) Jail Arraignment 21 Equipment Grants, at page 1639, is amended to read as follows: 22 (10) Jail Arraignment Equipment Grants: Included in the above General Fund 23 appropriation is a one-time allocation of $15,000,000 in fiscal year 2022-2023 for jail 24 arraignment equipment grants. The Department for Local Government shall coordinate 25 with the Kentucky Jailer's Association to implement a statewide video arraignment 26 system within county jails that is compatible with technology used by the Administrative 27 UNOFFICIAL COPY 23 RS HB 553/EN Page 4 of 8 HB055320.100 - 1266 - XXXX 3/30/2023 9:19 PM Engrossed Office of the Courts. Notwithstanding KRS 45.229, any portion of these funds that have 1 not been expended by the end of fiscal year 2022-2023 shall not lapse and shall carry 2 forward into fiscal year 2023-2024. 3 Section 4. 2022 Kentucky Acts Chapter 199, Part I, Operating Budget, A. 4 General Government, 9. Department for Local Government, (11) Community 5 Development Projects, at pages 1639 to 1640, as amended by 2022 Kentucky Acts 6 Chapter 239 and 2023 Regular Session HB 448, is further amended to read as follows: 7 (11) Community Development Projects: Included in the above General Fund 8 appropriation are the following one-time allocations for the 2022-2024 fiscal biennium: 9 (a) $3,500,000 in each fiscal year to the Boone's Ridge Appalachian Wildlife 10 Foundation for Boone's Ridge in Bell County; 11 (b) $15,000,000 in each fiscal year to the Todd County Fiscal Court for the 12 natural gas pipeline project; 13 (c) $200,000 in fiscal year 2022-2023 to the United Methodist Mountain Mission 14 to support operations; 15 (d) $400,000 in each fiscal year to the Kentucky Pilots Association Education 16 Foundation; 17 (e) $2,000,000 in fiscal year 2022-2023 to the Paducah Symphony; 18 (f) $4,300,000 in fiscal year 2022-2023 to the Louisville Orchestra; 19 (g) $100,000 in fiscal year 2022-2023 to the Hickman County Fiscal Court for the 20 Civil War Days; 21 (h) $2,500,000 in fiscal year 2022-2023 to the Paintsville High School STEM 22 Program; 23 (i) $10,000,000 in each fiscal year to the Lincoln County Fiscal Court for the 24 natural gas pipeline project; 25 (j) $200,000 in each fiscal year to the Backroads of Appalachia in Harlan, 26 Kentucky, to support economic development; 27 UNOFFICIAL COPY 23 RS HB 553/EN Page 5 of 8 HB055320.100 - 1266 - XXXX 3/30/2023 9:19 PM Engrossed (k) $1,500,000 in each fiscal year to the Russell County Regional Agribusiness 1 Training Facility; 2 (l) $750,000 in fiscal year 2022-2023 to the City of Lancaster for the fire 3 department substation; 4 (m) $500,000 in fiscal year 2023-2024 to the Fern Creek Community Center in 5 Louisville, Kentucky; 6 (n) $750,000 in fiscal year 2023-2024 to the Hart County Chamber of Commerce; 7 (o) $300,000 in fiscal year 2023-2024 to the City of Greensburg for beautification 8 projects; 9 (p) $20,000 in fiscal year 2022-2023 to the City of Wilmore for the Downtown 10 Greenstage; 11 (q) $6,000 in fiscal year 2022-2023 to the Jessamine County Fiscal Court for the 12 High Bridge Firehouse; 13 (r) $50,000 in fiscal year 2022-2023 to the Jessamine County Fiscal Court for 14 land acquisition at the High Bridge boat ramp; 15 (s) $1,400,000 in fiscal year 2022-2023 to the city of Williamsburg for 16 renovation and expansion of the Kentucky Splash Waterpark and Campground; 17 (t) $10,000,000 in fiscal year 2022-2023 to the Louisville Zoo for construction of 18 Kentucky trails habitat. Notwithstanding KRS 45.229, any portion of these funds that 19 have not been expended by the end of fiscal year 2022-2023 shall not lapse and shall 20 carry forward into fiscal year 2023-2024; 21 (u) $2,500,000 in fiscal year 2022-2023 to the City of Corbin for the Corbin 22 Arena and Corbin Center; 23 (v) $1,000,000 in fiscal year 2022-2023 to the City of Barbourville for 24 construction of[renovations to the] Barbourville City Hall; 25 (w) $1,250,000 in fiscal year 2022-2023 to the Jackson County Fiscal Court for a 26 new building for the Jackson County Emergency Medical Services; 27 UNOFFICIAL COPY 23 RS HB 553/EN Page 6 of 8 HB055320.100 - 1266 - XXXX 3/30/2023 9:19 PM Engrossed (x) $400,000 in fiscal year 2022-2023 to the KCEOC Community Action 1 Partnership for a vocational and technical training facility; 2 (y) $750,000 in fiscal year 2022-2023 to the City of Booneville for a city 3 revitalization project; 4 (z) $4,250,000 in fiscal year 2022-2023 to the Manchester/Clay County Tourism 5 Commission, Elk Hill Regional Industrial Authority, and Volunteers of America for land 6 acquisition, renovations, upgrades, and Elk Hill Spec Building and Housing; 7 (aa) $500,000 in fiscal year 2022-2023 to the Scott United Ministries A.M.E.N. 8 House for acquisition or construction of a new building; 9 (ab) $250,000 in fiscal year 2022-2023 to the Monroe County Fiscal Court to 10 allow the Monroe County Medical Center to begin offering emergency medical services 11 and paramedic training; 12 (ac) $600,000 in fiscal year 2022-2023 to the Housing Authority of Bowling 13 Green to create a small business incubator for low income, minority, and women-owned 14 businesses in collaboration with the city of Bowling Green; 15 (ad) $1,000,000 in fiscal year 2022-2023 to the City of Somerset Parks and 16 Recreation for upgrades to youth sports facilities; 17 (ae) $3,000,000 in fiscal year 2022-2023 to the Christian County Board of 18 Education for the Fort Campbell Industrial Training Partnership; 19 (af) $3,000,000 in fiscal year 2022-2023 to the Barren County Family YMCA 20 Foundation for a swimming pool facility, equipment, and HVAC and building repair; 21 (ag) $1,000,000 in fiscal year 2022-2023 to the Green County Fiscal Court for 22 industrial park site development; 23 (ah) $1,000,000 in fiscal year 2022-2023 to the Kentucky Science and Technology 24 Corporation for the VALOR program; 25 (ai) $1,000,000 in fiscal year 2022-2023 to USA Cares to support veterans and 26 their families; 27 UNOFFICIAL COPY 23 RS HB 553/EN Page 7 of 8 HB055320.100 - 1266 - XXXX 3/30/2023 9:19 PM Engrossed (aj) $650,000 in fiscal year 2022-2023 to Bellewood and Brooklawn to support 1 the Avenues to Success pilot program; 2 (ak) $5,000,000 in fiscal year 2022-2023 to the Bell County Fiscal Court to 3 support industrial projects; 4 (al) $1,000,000 in fiscal year 2023-2024 to the Green County Fiscal Court for the 5 American Legion Park Trail Development Project; and 6 (am) $195,000 in fiscal year 2022-2023 to Old Bardstown Village, Inc. for flood 7 damage repairs. 8 Section 5. 2022 Kentucky Acts Chapter 199, Part II, Capital Projects Budget, J. 9 Tourism, Arts and Heritage Cabinet, 2. Parks, at page 1747, is amended to read as 10 follows: 11 2. PARKS 12 001. Maintenance Pool - 2022-2024 13 General Fund 10,000,000 10,000,000 14 002. There is hereby appropriated Restricted Funds in the amount of 21 $31,200 in fiscal years 2022-2023 and 2023-2024 to the Board of Respiratory Care 22 budget unit to support continuing services. 23 Section 7. There is hereby appropriated Restricted Funds in the amount of 24 $80,000 in fiscal year 2022-2023 to the Board of Social Work budget unit to support 25 continuing services. 26 Section 8. Notwithstanding KRS 157.360(9), 157.410(3), 2021 (1st Extra.Sess.) 27 UNOFFICIAL COPY 23 RS HB 553/EN Page 8 of 8 HB055320.100 - 1266 - XXXX 3/30/2023 9:19 PM Engrossed Ky. Acts ch. 4, sec. 6, or any other statute to the contrary, the Department of Education 1 shall recalculate the exact final amount of the common school funds for fiscal year 2022-2 2023 on or before June 1, 2023. The Kentucky Department of Education shall utilize the 3 attendance data used to calculate each school district's respective SEEK distribution for 4 the 2022-2023 school year to effectuate KRS 157.360(9). No school district shall receive 5 less than the exact final amount of the common school funds for fiscal year 2022-2023 as 6 determined on or before March 1, 2023. 7 Section 9. Whereas the provisions of this Act provide ongoing support for state 8 government agencies and their functions, an emergency is declared to exist, and this Act 9 takes effect upon its passage and approval by the Governor or upon its otherwise 10 becoming a law. 11
