KRS 15.400 is amended to read as follows: 3 (1) The effective date of KRS 15.380 to 15.404 shall be December 1, 1998. All peace 4 officers employed as of December 1, 1998, shall be deemed to have met all the 5 requirements of KRS 15.380 to 15.404 and shall be granted certified status as long 6 as they: 7 (a) Remain in continuous employment of the agency by which they were 8 employed as of December 1, 1998, and are employed within three hundred 9 sixty-five (365)[one hundred (100)] days by another law enforcement agency 10 subject to the provisions of KRS 15.380 to 15.404; 11 (b) Retired from employment with certified status on or after July 1, 2008, and 12 are reemployed no later than one hundred (100) days from March 15, 2011, 13 by a law enforcement agency subject to KRS 15.380 to 15.404; or 14 (c) Have successfully completed an approved basic training course approved and 15 recognized by the Kentucky Law Enforcement Council pursuant to KRS 16 15.440(1)(d) when seeking employment with another law enforcement 17 agency. 18 (2) Any peace officers employed after December 1, 1998, shall comply with all 19 minimum standards specified in KRS 15.380 to 15.404 or comply with the 20 requirements set forth in KRS 15.440(1)(d)6. Persons newly employed or appointed 21 after December 1, 1998, shall have one (1) year within which to gain certified status 22 or they shall lose their law enforcement powers. 23 (3) The Open Records Act notwithstanding, the person's home address, telephone 24 number, date of birth, Social Security number, background investigation, medical 25 examination, psychological examination, and polygraph examination conducted for 26 any person seeking certification pursuant to KRS 15.380 to 15.404 shall not be 27 UNOFFICIAL COPY 23 RS HB 64/GA Page 2 of 2 HB006410.100 - 60 - XXXX 3/7/2023 7:45 PM GA subject to disclosure. 1 Section 2. Whereas it is critical to ensure that local school districts and local 2 police departments are able to attract and hire highly qualified peace officers, an 3 emergency is declared to exist and this Act takes effect upon its passage and approval by 4 the Governor or upon its otherwise becoming a law. 5
