AN ACT relating to state government. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘Section 1. KRS 61.101 is amended to read as follows: 3
As used in KRS 61.102 and 61.103, unless the context requires otherwise: 4
(1) "Employee" means a person in the service of the Commonwealth of Kentucky, or 5
any of its political subdivisions, who is under contract of hire, express or implied, 6
oral or written, where the Commonwealth, or any of its political subdivisions, has 7
the power or right to control and direct the material details of work performance; 8
(2) "Employer" means the Commonwealth of Kentucky or any of its political 9
subdivisions. Employer also includes any person authorized to act on behalf of the 10
Commonwealth, or any of its political subdivisions, with respect to formulation of 11
policy or the supervision, in a managerial capacity, of subordinate employees; and 12
(3) "Official request" means a request from members of the Kentucky General 13
Assembly and its employees; members of the Legislative Research Commission 14
and its committees and employees; the Auditor of Public Accounts and his or her 15
employees; the Attorney General and his or her employees; the Governor and 16
employees of the Governor's office; and members of the press. 17
