There is hereby appropriated General Fund moneys in the amount of 4 $16,630,000 in fiscal year 2022-2023 to the Bowling Green Veterans Center capital 5 project in the Veterans’ Affairs budget unit. 6 Section 2. Notwithstanding KRS 138.228, the average wholesale price of 7 gasoline for fiscal years 2022-2023 and 2023-2024 shall be the amount determined by the 8 Department of Revenue effective July 1, 2022. 9 Section 3. There is hereby appropriated General Fund moneys in the amount of 10 $22,999,200 in fiscal year 2022-2023 and $11,499,600 in fiscal year 2023-2024 to the 11 Highways budget unit within the Transportation Cabinet for the Biennial Highway 12 Construction Program. 13 Section 4. There is hereby appropriated General Fund moneys in the amount of 14 $21,400,800 in fiscal year 2022-2023 and $10,700,400 in fiscal year 2023-2024 to the 15 Revenue Sharing budget unit within the Transportation Cabinet which shall be allotted 16 using the same set asides as provided for in KRS 177.320, 177.360, 177.365, 177.366, 17 177.369, 179.410, and 179.415. 18 Section 5. There is hereby appropriated General Fund moneys to the Kentucky 19 Community and Technical College System budget unit in the amount of $4,000,000 in 20 fiscal year 2022-2023 and $4,000,000 in fiscal year 2023-2024 to make training grants 21 under the KCTCS-TRAINS Program. Notwithstanding KRS 164.092(1)(e), this 22 appropriation is excluded from the formula base amount. 23 Section 6. There is hereby appropriated General Fund moneys in the amount of 24 $2,208,800 in fiscal year 2022-2023 and $8,351,900 in fiscal year 2023-2024 to the 25 Workforce Development budget unit within the Education and Labor Cabinet to provide 26 the additional resources necessary to implement House Bill 4 from the 2022 Regular 27 UNOFFICIAL COPY 23 RS BR 933 Page 2 of 8 XXXX 12/29/2022 4:25 PM Jacketed Session. 1 Section 7. There is hereby appropriated Restricted Funds in the amount of 2 $4,000,000 in fiscal year 2022-2023 to the Replace Unemployment Insurance System 3 capital project in the Workforce Development budget unit within the Education and 4 Labor Cabinet to provide the additional resources necessary to implement House Bill 4 5 from the 2022 Regular Session. 6 Section 8. There is hereby appropriated General Fund moneys in the amount 7 $11,300,000 in fiscal year 2023-2024 to the Workforce Development budget unit within 8 the Education and Labor Cabinet for the restoration of 90 staff positions eliminated in 9 past budgets to provide in-person services to unemployed persons to assist with their 10 unemployment insurance claims at the 12 career centers across the state. 11 Section 9. There is hereby appropriated General Fund moneys in the amount of 12 $10,000,000 in fiscal year 2023-2024 to the Workforce Development budget unit within 13 the Education and Labor Cabinet for a Talent Attraction Media campaign to include 14 national and local outreach to recruit and retain top talent in Kentucky. 15 Section 10. There is hereby appropriated from the KEES Program Reserve 16 Account’s excess lottery receipts Restricted Funds in the amount of $2,100,000 in fiscal 17 year 2023-2024 to the Kentucky Higher Education Assistance Authority for a loan 18 forgiveness program for social service workers in Kentucky state government. The 19 Cabinet for Health and Family Services in cooperation with the Kentucky Higher 20 Education Assistance Authority shall establish the terms and conditions for the program. 21 Notwithstanding KRS 45.229, these funds shall not lapse and shall carry forward. 22 Section 11. There is hereby appropriated General Fund moneys in the amount 23 of $15,000,000 in fiscal year 2022-2023 to the to the Affordable Housing Trust Fund 24 (KRS 198A.710) to be used in areas named in a Presidential Declaration of Emergency 25 relating to the storms and tornadoes that occurred in December 2021 and in the areas 26 named in a Presidential Declaration of a Major Disaster, designated FEMA-4663-DR-27 UNOFFICIAL COPY 23 RS BR 933 Page 3 of 8 XXXX 12/29/2022 4:25 PM Jacketed KY, relating to the storms and flooding that occurred in July 2022. 1 Section 12. 2022 Kentucky Acts Chapter 199, Part I, Operating Budget, A. 2 General Government, 9. Department for Local Government, (11) Community 3 Development Projects, at pages 1639 to 1640, is amended to read as follows: 4 (11) Community Development Projects: Included in the above General Fund 5 appropriation are the following one-time allocations for the 2022-2024 fiscal biennium: 6 (a) $3,500,000 in each fiscal year to the Boone's Ridge Appalachian Wildlife 7 Foundation for Boone's Ridge in Bell County; and 2 (am) $195,000 in fiscal year 2022-2023 to Old Bardstown Village, Inc. for flood 3 damage repairs. 4 Section 13. 2022 Kentucky Acts Chapter 214, Part I, Operating Budget, A. 5 Transportation Cabinet, 4. Highways, (4) Highway Construction Contingency Account, 6 at page 2018, is amended to read as follows: 7 (4) Highway Construction Contingency Account: Included in the State 8 Supported Construction Program is $16,600,000 in each fiscal year for the Highway 9 Construction Contingency Account. Notwithstanding KRS 45.247[(2), ](4), (6), (7), and 10 (8), the Secretary shall only expend Highway Construction Contingency moneys for 11 projects of an emergency nature, for projects that relieve a hazardous condition, or to 12 provide the state match for unanticipated Federal Funds made available as a result of 13 other states not utilizing their total federal obligations. Notwithstanding KRS 224.43-14 505(2), included in the Highway Construction Contingency Account is $4,000,000 in 15 each fiscal year to support the Kentucky Pride Fund created in KRS 224.43-505. 16 Notwithstanding KRS 45.247 and 177.320(4), included in the Highway Construction 17 Contingency Account is $290,000 in each fiscal year for the Kentucky Transportation 18 Center. Also included in the Highway Construction Contingency Account for Railroads is 19 $1,600,000 in each fiscal year for public safety and service improvements which shall not 20 be expended unless matched with non-state funds equaling at least 20 percent of the total 21 amount for any individual project. Additionally, in each fiscal year, up to $350,000 of the 22 $1,600,000 appropriation may be used to establish and administer the Kentucky Rail 23 Office in the Kentucky Transportation Cabinet. 24 Section 14. There is hereby appropriated General Fund moneys in the amount 25 of $680,000 in fiscal year 2022-2023 to the Department for Local Government budget 26 unit for a repayment to the U.S. Department of Housing and Urban Development for a 27 UNOFFICIAL COPY 23 RS BR 933 Page 7 of 8 XXXX 12/29/2022 4:25 PM Jacketed portion of a Community Development Block Grant for economic development that was 1 disbursed for an ineligible activity by a local government recipient. 2 Section 15. 2022 Kentucky Acts Chapter 199, Part I, Operating Budget, H. 3 Justice and Public Safety Cabinet, 5. Corrections, c. Community Services and Local 4 Facilities, (11) Substance Abuse, Mental Health, and Reentry Service Centers, at page 5 1688, is amended to read as follows: 6 (11) Substance Abuse, Mental Health, and Reentry Service Centers: (a)7 Notwithstanding any statute to the contrary, for each fiscal year, the Department of 8 Corrections shall pay each contracted provider of substance abuse, mental health, and 9 reentry centers for only those beds that are occupied by individuals assigned by the 10 Department of Corrections[a minimum of 65 percent of the contracted beds monthly]. 11 Any contracted, but unfilled contracted beds as of the effective date of this Act may, at 12 the discretion of the provider, be terminated. 13 (b) Each contracted provider, as provided for in paragraph (a) of this subsection, 14 shall report 100 percent of their occupancy to the Department of Corrections. The report 15 shall detail the total number of beds, the number of beds available, the type of individual 16 occupying bed space, and shall be submitted in a method and at a frequency established 17 by the Department's discretion. 18 (c) Notwithstanding any statute to the contrary, the Department of Corrections 19 shall be permitted to negotiate an inflationary price increase for contracted providers of 20 substance abuse, mental health, and reentry centers during the COVID-19 state of 21 emergency. 22 Section 16. The 2023 General Assembly hereby approves the Department of 23 Parks’ comprehensive statewide proposal submitted to the Interim Joint Committee on 24 Appropriations and Revenue. 25 Section 17. Whereas the operations of governmental agencies are imperative for 26 the betterment of the Commonwealth, an emergency is declared to exist, and this Act 27 UNOFFICIAL COPY 23 RS BR 933 Page 8 of 8 XXXX 12/29/2022 4:25 PM Jacketed takes effect upon its passage and approval by the Governor or upon its otherwise 1 becoming a law. 2
