AN ACT relating to biosolids. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF SUBCHAPTER 50 OF KRS CHAPTER 3
224 IS CREATED TO READ AS FOLLOWS: 4
(1) As used in this section, "biosolids" means nutrient-rich, organic, residual 5
material that results from the treatment of domestic sewage or sewage sludge in a 6
treatment facility and can be recycled and applied as a fertilizer to improve and 7
maintain productive soils. 8
(2) Notwithstanding any provision of law to the contrary, when biosolids are 9
generated from wastewater treatment at a publicly owned treatment works, the 10
biosolids shall be: 11
(a) Designated a special waste; and 12
(b) Regulated in conformance with the most recent version of 40 C.F.R. pt. 503. 13
(3) The cabinet shall promulgate administrative regulations pursuant to KRS 14
Chapter 13A to implement the provisions of this section no more than thirty (30) 15
days after the effective date of this Act. The administrative regulations 16
promulgated pursuant to this section shall not be more stringent than federal 17
rules governing the disposal of biosolids. 18
