PURPOSE OF MEASURE: The measure transfers the authority to make the conservation 
easement acquisitions required under 2022 Regular Session Senate Bill 217 from the Finance 
and Administration Cabinet (FAC) to the Department of Fish and Wildlife Resources (DFWR). 
It provides carryforward authority for previously appropriated General Fund moneys for the 
Kentucky Cumberland Forest Conservation Program. It adds the DFWR to the definition of a 
procuring agency, removes any provision of KRS Chapter 45A that requires the approval of any 
FAC official for any aspect of the procurement process, and requires the Auditor of Public 
Accounts to examine policies and procedures. It establishes an engineering and engineering 
related services selection committee and outlines procurement procedures for engineering related 
services to the Department of Fish and Wildlife Resources. It gives the Kentucky Fish and 
Wildlife Commission approval authority over the DFWR contracts.  
 
FISCAL EXPLANATION : The DFWR has stated they will need to procure outside legal 
counsel who has real property acquisition experience for the conservation easement acquisitions. 
The estimated cost of this procurement is unknown. The DFWR will also need to hire at least 
one additional procurement officer at an estimated $105,000 annually for salary and fringe 
benefits.
