A NEW SECTION OF KRS CHAPTER 189 IS CREATED TO 3 READ AS FOLLOWS: 4 (1) As used in this section: 5 (a) "Local government" means any city, county, urban-county government, 6 consolidated local government, charter county government, or unified local 7 government of the Commonwealth; 8 (b) "Participant" means any person who drives or maintains a motor vehicle 9 used in a racing event; 10 (c) "County roads" has the same meaning as in KRS 178.010(1)(b); 11 (d) "Streets" has the same meaning as in KRS 177.365(4); and 12 (e) "Racing event" means a motor vehicle race which is sanctioned by a 13 nationally or internationally recognized racing organization and includes 14 preparations, practices, and qualifications for the race. 15 (2) A local government may provide permits to allow a racing event within its 16 jurisdiction: 17 (a) On county roads; 18 (b) On streets; or 19 (c) At airports, subject to approval from the relevant airport board. 20 (3) A local government may charge an applicant for a permit under this section: 21 (a) An application fee not to exceed one thousand dollars ($1,000); and 22 (b) The cost of any expenses incurred by the local government to facilitate the 23 racing event. 24 (4) A local government that issues a permit for a racing event shall ensure the 25 applicant for the permit has: 26 (a) Adequate insurance to pay any damages incurred because of loss or injury 27 UNOFFICIAL COPY 23 RS SB 96/GA Page 2 of 3 SB009610.100 - 1057 - XXXX 3/14/2023 3:23 PM GA to any person or property; 1 (b) Adequate security, emergency services, and necessary facilities provided 2 during the racing event; and 3 (c) The ability to protect the health, safety, and welfare of the citizens of the 4 local government, the race participants, and those attending the racing 5 event. 6 (5) For the facilitation of a racing event sanctioned under this section, a local 7 government may: 8 (a) Temporarily close roads, streets, alleys, sidewalks, and airport runways; 9 (b) Reroute pedestrian and motor vehicle traffic; and 10 (c) Waive local ordinances and traffic regulations. 11 (6) No less than sixty (60) days prior to a scheduled racing event, a local government 12 shall provide written notice to the Transportation Cabinet of any racing event 13 permit issued under this section. The written notice shall include: 14 (a) The time, date, and location of the racing event; 15 (b) The nationally or internationally recognized racing organization sponsoring 16 the event; 17 (c) A road closure plan that specifies the streets, roads, alleys, sidewalks, and 18 airport runways that will be temporarily closed or obstructed during the 19 racing event; 20 (d) A traffic control plan that specifies the on-site traffic controls and detour 21 routes to be used during the racing event; and 22 (e) The names and phone numbers of emergency and law enforcement contacts 23 overseeing the racing event. 24 (7) The route of a racing event under this section shall not use or cross any state 25 maintained highway. 26 (8) A local government that issues a permit under this section shall not be liable for 27 UNOFFICIAL COPY 23 RS SB 96/GA Page 3 of 3 SB009610.100 - 1057 - XXXX 3/14/2023 3:23 PM GA any damages that may result from the racing event of loss or injury to persons or 1 property. After a permit is issued, the Commonwealth shall not be liable for any 2 damages that may result from the racing event of loss or injury to persons or 3 property. 4 (9) So long as the participants adhere to all requirements and regulations set forth by 5 the nationally or internationally recognized racing organization sponsoring the 6 racing event, participants in a racing event under this section shall be exempt 7 from all vehicle equipment and operation standards of this chapter. 8
