A JOINT RESOLUTION directing the Department of Alcoholic Beverage Control 1 
to study its licensing fee structure. 2 
WHEREAS, the landscape of legal alcoholic beverage sales across the 3 
Commonwealth has dramatically changed over the past few years to now include one 4 
hundred ten counties; and 5 
WHEREAS, the pandemic and e-commerce have jointly accelerated the expansion 6 
of home and direct alcoholic beverage delivery services; and 7 
WHEREAS, the Commonwealth has an interest in regulating the alcoholic 8 
beverage industry while simultaneously supporting its business growth through 9 
responsible taxation and licensing; 10 
NOW, THEREFORE, 11 
Be it resolved by the General Assembly of the Commonwealth of Kentucky: 12 
Section 1.   The Department of Alcoholic Beverage Control shall study: 13 
(1) The actual costs involved in: 14 
(a) Issuing a license; 15 
(b) Regulating a license; 16 
(c) Adjudicating violations against a license; and 17 
(d) Collecting all fees; and 18 
(2) Whether fees should be increased or decreased. 19 
Section 2.   The department shall undertake a review of its licensing fee structure 20 
in all three tiers to determine the reasonableness of the current fee structure in covering 21 
the actual cost of regulating the alcoholic beverage industry in the Commonwealth. 22 
Section 3.   The department shall make recommendations regarding: 23 
(1) Identified duplicative processes; 24 
(2) Necessary changes to create greater uniformity and consistency for licensees 25 
and licensee enforcement; 26

(4) Whether and which fees should be increased or decreased. 1 
Section 4.   The department shall submit its findings to the Legislative Research 2 
Commission for referral to the appropriate committee or committees by December 1, 3 
2023. 4
