AN ACT relating to patient medical records. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 422 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) As used in this section, "personal representative" means an individual who has 5
authority under state law to make health care decisions for a patient. 6
(2) Any statutes to the contrary notwithstanding, the parent of a patient who is under 7
the age of eighteen (18), or a patient's personal representative on behalf of a 8
patient who is under the age of eighteen (18), shall have the right to access and 9
receive a copy of the patient's health information maintained by a health care 10
provider or health care facility in a medical record or chart unless prohibited 11
under the federal Health Insurance Portability and Accountability Act of 1996 or 12
any other federal or state law. 13
