AN ACT relating to Medicaid coverage for certified professional midwifery 1 
services. 2 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 3 
SECTION 1.   A NEW SECTION OF KRS CHAPTER 205 IS CREATED TO 4 
READ AS FOLLOWS: 5 
(1) As used in this section, "certified professional midwifery services" and "licensed 6 
certified professional midwife" have the same meaning as in KRS 314.400. 7 
(2) Notwithstanding any provision of law to the contrary, the Department for 8 
Medicaid Services and any managed care organization with whom the 9 
department contracts for the delivery of Medicaid services shall provide coverage 10 
for certified professional midwifery services when provided by a licensed certified 11 
professional midwife. 12 
(3) The Department for Medicaid Services shall promulgate administrative 13 
regulations as necessary in accordance with KRS Chapter 13A to carry out this 14 
section, including but not limited to utilization management and prior 15 
authorization requirements which shall be consistent with KRS 304.17A-607. 16 
Section 2.   If the Cabinet for Health and Family Services determines that a state 17 
plan amendment, waiver, or any other form of approval or authorization from a federal 18 
agency is necessary prior to the implementation of Section 1 of this Act, the cabinet shall, 19 
within 90 days after the effective date of this Act, request the state plan amendment, 20 
waiver, approval, or authorization and shall only delay full implementation of those 21 
provisions for which a state plan amendment, waiver, approval, or authorization was 22 
deemed necessary until the state plan amendment, waiver, approval, or authorization is 23 
granted. The cabinet shall, in accordance with KRS 205.525, provide a copy of any state 24 
plan amendment, waiver, or other approval or authorization submitted pursuant to this 25 
section to the Interim Joint Committee on Health Services and the Interim Joint 26 
Committee on Appropriations and Revenue and shall provide an update on the status of 27  UNOFFICIAL COPY  	24 RS BR 382

any application submitted pursuant to this section to the Legislative Research 1 
Commission upon request. 2
