UNOFFICIAL COPY 24 RS HB 18/GA Page 1 of 2 HB001810.100 - 810 - XXXX 1/23/2024 3:12 PM GA AN ACT relating to the rights of property owners and declaring an emergency. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 SECTION 1. A NEW SECTION OF KRS CHAPTER 65 IS CREATED TO 3 READ AS FOLLOWS: 4 A city, county, charter county government, urban-county government, consolidated 5 local government, or unified local government shall not adopt or enforce an ordinance 6 or regulation that prohibits any owner, lessee, sublessee, assignee, managing agent, or 7 other person having the authority to lease, sublease, or rent a housing accommodation 8 from refusing to lease or rent the housing accommodation to any person when the 9 person's lawful source of income to pay rent includes funding from a federal housing 10 assistance program. 11 SECTION 2. A NEW SECTION OF KRS CHAPTER 65 IS CREATED TO 12 READ AS FOLLOWS: 13 (1) As used in this section: 14 (a) "Emergency response" means a response by any first responder to a 15 reported incident that is of such an emergent nature that jeopardizes or 16 could jeopardize personal safety or result in the destruction of property; 17 (b) "Emergency response fee" means any charge or fee, other than a 18 membership charge or subscriber fee levied under KRS Chapter 273, 19 imposed by a fire department, whether paid or volunteer, ambulance 20 provider, law enforcement agency, or other organization to cover the costs 21 associated with an emergency response, including but not limited to costs 22 incurred for labor, materials, supplies or equipment used or provided in the 23 response; and 24 (c) "First responder" means fire, police, and emergency medical personnel. 25 (2) No local government, special district, or other provider of any emergency 26 response service shall submit any demand for payment or require an owner of 27 UNOFFICIAL COPY 24 RS HB 18/GA Page 2 of 2 HB001810.100 - 810 - XXXX 1/23/2024 3:12 PM GA property occupied by an individual other than the owner to pay any emergency 1 response fee that arises out of the actions of another over which the owner has no 2 control. 3 Section 3. Whereas it is important to ensure that the rights of property owners 4 are respected, an emergency is declared to exist and this Act takes effect upon its passage 5 and approval by the Governor or upon its otherwise becoming a law. 6
