AN ACT relating to low-speed vehicles and declaring an emergency. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
Section 1. KRS 189.282 is amended to read as follows: 3
(1) As used in this section, "low-speed vehicle" shall have the same meaning as in KRS 4
186.010. 5
(2) A person may operate a low-speed vehicle on a highway if: 6
(a) The vehicle meets the federal motor vehicle safety standards for low-speed 7
vehicles set forth in 49 C.F.R. sec. 571.500; 8
(b) The vehicle displays a seventeen (17) character vehicle identification number 9
that meets the requirements set forth in 49 C.F.R. pt. 565; 10
(c) The posted speed limit of the highway is thirty-five (35) miles per hour or 11
less; 12
(d) The operator of the low-speed vehicle does not cross a roadway at an at-grade 13
intersection where the roadway being crossed has a posted speed limit of more 14
than thirty-five (35) miles per hour unless the intersection is equipped with an 15
electronic traffic signal; 16
(e) The operator has a valid operator's license in his or her possession; and 17
(f) The low-speed vehicle has not been modified to increase its speed above its 18
original standard manufactured limit. 19
(3) A low-speed vehicle operating on a highway shall be insured in compliance with 20
KRS 304.39-080 by the owner or operator, and the proof of insurance shall be 21
inside the vehicle at all times of operation on a highway. 22
(4) A low-speed vehicle operating on a highway is considered to be a motor vehicle as 23
defined in KRS 186.010 and shall be titled in accordance with KRS Chapter 186A 24
and registered as a motor vehicle in accordance with KRS 186.050(3)(a). 25
(5) Except as provided in subsection (6) of this section, an operator of a low-speed 26
vehicle operating on a highway shall comply with the traffic regulations of KRS 27 UNOFFICIAL COPY 24 RS HB 249/GA

Chapter 189 and shall be subject to the provisions of KRS Chapter 189A. 1
(6) A low-speed vehicle that complies with the federal motor vehicle safety standards 2
for low-speed vehicles set forth in 49 C.F.R. sec. 571.500 shall not: 3
(a) Be subject to any additional federal motor vehicle safety standards or any 4
vehicle equipment standards in this chapter that are not applicable to low-5
speed vehicles; or 6
(b) Have the Transportation Cabinet refuse to register it as a motor vehicle 7
because it does not meet any additional federal motor vehicle safety 8
standards or any vehicle equipment standards in this chapter that are not 9
applicable to low-speed vehicles. 10
Section 2. Whereas recent communications with Kentucky drivers have caused 11
confusion over the ability to register low-speed vehicles in the Commonwealth, an 12
emergency is declared to exist, and this Act takes effect upon its passage and approval by 13
the Governor or upon its otherwise becoming a law. 14
