AN ACT relating to road projects and declaring an emergency. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
Section 1. Notwithstanding KRS 48.100, 48.110, 48.300, and 176.430, the 3
projects authorized by the General Assembly in this Act constitute the official 2024-2026 4
Biennial Highway Construction Plan. 5
Section 2. The General Assembly acknowledges that the project authorizations 6
contained within this Act are based on the Transportation Cabinet's estimates. The 7
Transportation Cabinet shall have the authority to expend funds necessary to complete 8
the projects as authorized in this Act, amended only by variations dictated by bid or 9
unforeseen circumstances. 10
Section 3. The Secretary of the Transportation Cabinet shall produce a single 11
document that shall detail the enacted fiscal biennium 2024-2026 Biennial Highway 12
Construction Program, County Priority Projects Program, and the 2026-2030 Highway 13
Preconstruction Plan. 14
Section 4. Notwithstanding KRS 48.300, this Act in conjunction with 2024 15
Regular Session HJR 91 and 2024 Regular Session HJR 92 shall constitute the Six-Year 16
Road Plan. 17
Section 5. Whereas the funding for these projects is provided by the 18
Transportation Cabinet Budget Bill, which takes effect upon its passage and approval by 19
the Governor or upon its otherwise becoming a law, an emergency is declared to exist 20
and this Act takes effect upon its passage and approval by the Governor or upon its 21
otherwise becoming a law. 22
