UNOFFICIAL COPY 24 RS BR 1222 Page 1 of 3 XXXX 12/19/2023 11:15 AM Jacketed AN ACT relating to motor vehicles. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 Section 1. KRS 189.503 is amended to read as follows: 3 (1) As used in this section: 4 (a) "County roads" has the same meaning as in KRS 178.010(1)(b); 5 (b) "Local government" means any city, county, urban-county government, 6 consolidated local government, charter county government, or unified local 7 government of the Commonwealth; 8 (c) "Participant" means any person who drives or maintains a motor vehicle used 9 in a racing event; 10 (d) "Racing event" means a motor vehicle race which is sanctioned by a 11 nationally or internationally recognized racing organization and includes 12 preparations, practices, and qualifications for the race; and 13 (e) "Streets" has the same meaning as in KRS 177.365(4). 14 (2) A local government may provide permits to allow a racing event within its 15 jurisdiction: 16 (a) On county roads; 17 (b) On streets; 18 (c) On state-maintained highways in accordance with subsection (7) of this 19 section; or 20 (d)[(c)] At airports, subject to approval from the relevant airport board. 21 (3) A local government may charge an applicant for a permit under this section: 22 (a) An application fee not to exceed one thousand dollars ($1,000); and 23 (b) The cost of any expenses incurred by the local government to facilitate the 24 racing event. 25 (4) A local government that issues a permit for a racing event shall ensure the applicant 26 for the permit has: 27 UNOFFICIAL COPY 24 RS BR 1222 Page 2 of 3 XXXX 12/19/2023 11:15 AM Jacketed (a) Adequate insurance to pay any damages incurred because of loss or injury to 1 any person or property; 2 (b) Adequate security, emergency services, and necessary facilities provided 3 during the racing event; and 4 (c) The ability to protect the health, safety, and welfare of the citizens of the local 5 government, the race participants, and those attending the racing event. 6 (5) For the facilitation of a racing event sanctioned under this section, a local 7 government may: 8 (a) Temporarily close roads, streets, highways, alleys, sidewalks, and airport 9 runways; 10 (b) Reroute pedestrian and motor vehicle traffic; and 11 (c) Waive local ordinances and traffic regulations. 12 (6) No less than sixty (60) days prior to a scheduled racing event, a local government 13 shall provide written notice to the Transportation Cabinet of any racing event 14 permit issued under this section. The written notice shall include: 15 (a) The time, date, and location of the racing event; 16 (b) The nationally or internationally recognized racing organization sponsoring 17 the event; 18 (c) A road closure plan that specifies the streets, roads, highways, alleys, 19 sidewalks, and airport runways that will be temporarily closed or obstructed 20 during the racing event; 21 (d) A traffic control plan that specifies the on-site traffic controls and detour 22 routes to be used during the racing event; [and] 23 (e) The names and phone numbers of emergency and law enforcement contacts 24 overseeing the racing event; and 25 (f) If applicable, a request to cross or use a portion of a state-maintained 26 highway as part of the route in accordance with subsection (7) of this 27 UNOFFICIAL COPY 24 RS BR 1222 Page 3 of 3 XXXX 12/19/2023 11:15 AM Jacketed section. 1 (7) The route of a racing event under this section that uses or crosses[shall not use or 2 cross] any state-maintained highway shall be subject to prior approval by the 3 Transportation Cabinet. 4 (8) So long as the participants adhere to all requirements and regulations set forth by 5 the nationally or internationally recognized racing organization sponsoring the 6 racing event, participants in a racing event under this section shall be exempt from 7 all vehicle equipment and operation standards of this chapter. 8 Section 2. KRS 189.505 is amended to read as follows: 9 No person shall engage upon any street or highway in motor vehicle racing, drag racing, 10 or any other form of competition involving motor vehicles, except racing events 11 permitted under Section 1 of this Act. 12
