UNOFFICIAL COPY 24 RS BR 1645 Page 1 of 2 XXXX 1/18/2024 8:56 AM Jacketed AN ACT relating to the safety of canines and felines. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 411 IS CREATED TO 3 READ AS FOLLOWS: 4 (1) As used in this section, "passenger compartment" means the area of a car or 5 truck designed and intended for the seating of the operator or passengers. 6 (2) A person who enters the passenger compartment of a car or truck for the purpose 7 of removing a dog or cat shall be immune from civil liability for any resulting 8 damage to the car or truck if the person: 9 (a) 1. Makes a reasonable effort to locate the owner or other person 10 responsible for the dog or cat; 11 2. Contacts local law enforcement, the local fire department, local 12 animal control officers, or a 911 emergency telephone service prior to 13 entering the car or truck; and 14 3. Has a reasonable, good faith belief, based upon the circumstances 15 known to the person at the time, that entry into the passenger 16 compartment is necessary because the dog or cat is in imminent 17 danger of death if not immediately removed from the car or truck; 18 (b) Uses no more force to enter the car or truck and remove the dog or cat than 19 is reasonably necessary under the circumstances; and 20 (c) 1. Remains with the dog or cat in a safe location, out of the elements but 21 reasonably close to the car or truck, until law enforcement, 22 firefighters, animal control officers, or other emergency responders 23 arrive; or 24 2. The person's contact information; 1 b. The reason entry into the car or truck was made; 2 c. The location of the dog or cat; and 3 d. Notice that authorities have been contacted, and specifically 4 which law enforcement agency or emergency services were 5 contacted. 6 (3) This section does not limit a person's immunity from civil liability or defenses 7 established in another section of the Kentucky Revised Statutes or available at 8 common law. 9
