UNOFFICIAL COPY 24 RS BR 1634 Page 1 of 53 XXXX 1/24/2024 4:26 PM Jacketed AN ACT relating to real property boards. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 SECTION 1. A NEW SECTION OF KRS CHAPTER 12 IS CREATED TO 3 READ AS FOLLOWS: 4 (1) (a) The Division of Real Property Boards is hereby created within the Public 5 Protection Cabinet and shall include the: 6 1. Kentucky Board of Home Inspectors, created under Section 2 of this 7 Act; 8 2. Real Estate Appraisers Board, created under Section 7 of this Act; and 9 3. Board of Auctioneers, created under section 14 of this Act. 10 (b) The division shall be managed by an executive director, who shall be 11 appointed by the secretary of the Public Protection Cabinet with prior 12 written approval of the Governor. The executive director shall be exempted 13 from the classified service. 14 (c) The division may: 15 1. Provide appropriate attorneys, personnel staffing and administrative 16 support to the real property boards identified in paragraph (a) of this 17 subsection; 18 2. Establish and maintain an office, meeting space, office supplies, 19 furniture, storage space, and any other supplies that are necessary to 20 carry out the duties of the division and the real property boards 21 identified in paragraph (a) of this subsection; 22 3. Make available for public inspection all decisions, opinions, and 23 interpretations formulated or used by the division and the real 24 property boards identified in paragraph (a) of this subsection in 25 discharging their functions; 26 4. Publicize the functions and purposes of the division and the real 27 UNOFFICIAL COPY 24 RS BR 1634 Page 2 of 53 XXXX 1/24/2024 4:26 PM Jacketed property boards identified in paragraph (a) of this subsection; 1 5. Employ administrative coordinators who shall carry out the 2 administrative functions and day-to-day operations of the real 3 property boards identified in paragraph (a) of this subsection. The 4 maximum number of administrative coordinators shall be one (1) for 5 each real property board. These administrative coordinators shall be 6 exempted from the classified service; and 7 6. Enter into agreements with any state agency, political subdivision of 8 the state, postsecondary education institution, or other person or entity 9 to assist with implementation of the duties and responsibilities of the 10 division or, upon request, the real property boards identified in 11 paragraph (a) of this subsection. 12 (2) The executive director of the division shall: 13 (a) Provide oversight of the division; 14 (b) Review and provide feedback on any administrative regulation proposed by 15 any of the boards within the division prior to the promulgation of the 16 administrative regulation; 17 (c) Review and provide feedback on the budgets and expenditures of the boards 18 within the division; 19 (d) Pursuant to KRS 13B.120(7), automatically hear and issue a final order 20 regarding any decision of a real property board that would otherwise be 21 subject to appeal. An aggrieved party may appeal a final order of the 22 executive director pursuant to KRS Chapter 13B within thirty (30) days 23 after the issuance of the order to the Circuit Court of the county where the 24 party has his or her principal place of business or where the party resides; 25 (e) Make available for public inspection all decisions, opinions, and 26 interpretations formulated or used by the executive director in discharging 27 UNOFFICIAL COPY 24 RS BR 1634 Page 3 of 53 XXXX 1/24/2024 4:26 PM Jacketed his or her functions; 1 (f) Carry out the applicable policy and program directives of the Public 2 Protection Cabinet; 3 (g) Prepare annual reports on the executive director's activities; 4 (h) Delegate any power to employees and contractors as needed; 5 (i) Have at least ten (10) years of experience in any one (1) of the professions 6 under the jurisdiction of a real property board within the division; and 7 (j) Perform all other duties assigned by law. 8 Section 2. KRS 198B.704 is amended to read as follows: 9 (1) (a) There is hereby created an independent agency of state government to be 10 known as the Kentucky Board of Home Inspectors, which shall be attached to 11 the Division of Real Property Boards[Department of Professional Licensing] 12 for administrative purposes. The board shall consist of five (5) members, each 13 appointed by the Governor. Each board member shall serve a term of three (3) 14 years. The board shall annually select one (1) of its members to serve as chair 15 and one (1) of its members to serve as vice chair to act in the chair's absence. 16 The board shall designate either a board member or a member of the board's 17 administrative staff to serve as secretary to the board. 18 (b) Any member appointed to fill a vacancy occurring other than by expiration of 19 a term shall be appointed for the remainder of the unexpired term. 20 (c) No more than three (3) members of the same political party shall serve on the 21 board at the same time. 22 (d) No member of the board shall reside in the same county as another member. 23 The members of the board shall be residents of Kentucky. 24 (e) 1. A majority of the board shall constitute a quorum for the transaction of 25 business. The affirmative vote of a majority of the members is necessary 26 for the board to take official action. 27 UNOFFICIAL COPY 24 RS BR 1634 Page 4 of 53 XXXX 1/24/2024 4:26 PM Jacketed 2. If the chair and vice chair are absent from a meeting of the board when a 1 quorum exists, the members who are present may elect a presiding 2 officer who shall serve as acting chair until the conclusion of the 3 meeting or until the arrival of the chair or vice chair. 4 (f) No member may serve on the board for more than six (6) consecutive years. A 5 member may serve on the board for six (6) consecutive years on more than 6 one (1) occasion if that person is not a member of the board for at least two 7 (2) years between periods of board service. 8 (2) The five (5) members of the board shall be chosen as follows: 9 (a) Three (3) members shall: 10 1. Have been actively engaged in performing home inspections in 11 Kentucky for at least five (5) years immediately before the member's 12 appointment to the board, or have completed no less than one hundred 13 (100) fee-paid inspections per year over the last five (5) years; and 14 2. Be licensed by the board as a home inspector; 15 (b) One (1) member shall represent the public at large and shall not be associated 16 with the home inspection, home building, or real estate business other than as 17 a consumer; and 18 (c) One (1) member shall be a real estate professional licensed under KRS 19 Chapter 324 who has been actively engaged in selling, trading, exchanging, 20 optioning, leasing, renting, managing, or listing residential real estate in 21 Kentucky for at least five (5) years immediately before the member's 22 appointment to the board. This member shall be selected from a list of three 23 (3) names submitted to the Governor from the Kentucky Association of 24 Realtors. When a vacancy occurs in this member position, the Kentucky 25 Association of Realtors shall have sixty (60) days after the vacancy occurs to 26 submit a list of three (3) names to the Governor to fill the vacancy. The 27 UNOFFICIAL COPY 24 RS BR 1634 Page 5 of 53 XXXX 1/24/2024 4:26 PM Jacketed Governor may reject the list of three (3) names and request that the Kentucky 1 Association of Realtors submit a new list of three (3) names within sixty (60) 2 days of the Governor's request. If the Kentucky Association of Realtors fails 3 to timely submit this list to the Governor, the Governor may immediately 4 appoint a qualified person to fill this vacancy. 5 (3) A board member shall be automatically removed from the board and a vacancy 6 shall occur when the board member: 7 (a) Ceases to be a resident of the Commonwealth of Kentucky; 8 (b) Displays incompetence, neglect of duty, or unprofessional conduct; 9 (c) Fails to adhere to a duly adopted code of ethics of the board. Failure to adhere 10 to this code shall be determined by official action of the board; 11 (d) Enters a plea of guilty to, or has been found guilty of, a felony and the time 12 for appeal has passed or the judgment of conviction has been finally affirmed 13 on appeal; or 14 (e) Misses three (3) consecutive meetings or misses more than twenty-five 15 percent (25%) of the meetings held over the previous twelve (12) month 16 period. 17 (4) Voting members of the board shall be compensated no more than three hundred 18 dollars ($300) per day for official business, subject to an annual maximum of six 19 thousand dollars ($6,000). Members shall be reimbursed for all expenses paid and 20 incurred in the discharge of official business consistent with the reimbursement 21 policy for state employees. With the approval of the executive director of the 22 Division of Real Property Boards within the Public Protection Cabinet[executive 23 director of the Kentucky Real Estate Authority within the Department of 24 Professional Licensing], board members and board staff may attend and travel to 25 and from meetings and events relevant to the board or the industry the board 26 represents. 27 UNOFFICIAL COPY 24 RS BR 1634 Page 6 of 53 XXXX 1/24/2024 4:26 PM Jacketed (5) The board shall meet at least quarterly each calendar year upon the call of the chair 1 or the written request of a majority of the members of the board. 2 (6) The chair shall establish the date, time, and place for each meeting. 3 Section 3. KRS 198B.706 is amended to read as follows: 4 The board shall: 5 (1) Through the promulgation of administrative regulations: 6 (a) Determine the requirements for and prescribe the form of licenses, 7 applications, and other documents that are required by KRS 198B.700 to 8 198B.738; and 9 (b) Require that a home inspection report include a statement that the home 10 inspection report does not address environmental hazards and list all other 11 exclusions with specificity; 12 (2) Grant, deny, suspend, and revoke approval of examinations and courses of study 13 regarding home inspections; 14 (3) Issue or deny applications for licensure and renewals; 15 (4) Investigate complaints concerning licensees, or persons the board has reason to 16 believe should be licensees, including complaints concerning failure to comply with 17 KRS 198B.700 to 198B.738 or administrative regulations promulgated under KRS 18 198B.700 to 198B.738, and, when appropriate, take action in accordance with KRS 19 198B.728 and 198B.730; 20 (5) Bring actions in the name of the state in an appropriate court in order to enforce 21 compliance with KRS 198B.700 to 198B.738 or the administrative regulations 22 promulgated under KRS 198B.700 to 198B.738; 23 (6) Establish license fees in an amount not to exceed two hundred fifty dollars ($250) 24 annually; 25 (7) Inspect the records of a licensee in accordance with administrative regulations 26 promulgated by the board; 27 UNOFFICIAL COPY 24 RS BR 1634 Page 7 of 53 XXXX 1/24/2024 4:26 PM Jacketed (8) Conduct or designate a member or other representative to conduct public hearings 1 on any matter for which a hearing is required under KRS 198B.728 and 198B.730; 2 (9) Adopt a seal containing the words "Kentucky Board of Home Inspectors" and, 3 through the board's secretary, certify copies and authenticate all acts of the board; 4 (10) Use counsel, consultants, and other persons, enter into contracts, and authorize 5 expenditures that are reasonably necessary or appropriate to administer and enforce 6 KRS 198B.700 to 198B.738 and administrative regulations promulgated 7 thereunder; 8 (11) Establish continuing education requirements for licensed home inspectors in 9 accordance with KRS 198B.722 and 198B.724; 10 (12) Conduct disciplinary actions against licensees to include: 11 (a) Suspension, probation, or permanent revocation of a license; 12 (b) Requiring a licensee to obtain additional continuing education; and 13 (c) Issuance of a written reprimand; 14 (13) Require all fee-paid home inspections to be conducted in accordance with the 15 standards of practice of: 16 (a) The American Society of Home Inspectors; 17 (b) The International Association of Certified Home Inspectors; or 18 (c) Any other approved standards of practice that are equal to the standards of 19 practice of the organizations in paragraphs (a) and (b) of this subsection as 20 determined by the board. 21 The board may establish standards of practice for home inspectors licensed in 22 Kentucky at a later date, which will supersede any other standards of practice 23 previously adopted by the board and, if adopted by regulation, the standards in 24 paragraphs (a) and (b) of this subsection; 25 (14) Exercise all other powers specifically conferred on the board under KRS 198B.700 26 to 198B.738; and 27 UNOFFICIAL COPY 24 RS BR 1634 Page 8 of 53 XXXX 1/24/2024 4:26 PM Jacketed (15) Promulgate administrative regulations to carry out the effective administration and 1 the requirements of KRS 198B.700 to 198B.738, following review by[with the 2 approval of] the executive director of the Division of Real Property 3 Boards[Kentucky Real Estate Authority]. 4 Section 4. KRS 198B.728 is amended to read as follows: 5 (1) The board shall take disciplinary actions against or impose sanctions on a licensee 6 for failing to comply with any provision of KRS 198B.700 to 198B.738 or any 7 administrative regulations promulgated to carry out KRS 198B.700 to 198B.738. 8 (2) Pursuant to KRS 13B.120(7), the executive director of the Kentucky Real Estate 9 Authority within the Public Protection Cabinet[Department of Professional 10 Licensing] shall hear and issue a final order regarding any decision of the board. An 11 aggrieved party may appeal a final order of the executive director pursuant to KRS 12 Chapter 13B within thirty (30) days after the issuance of the order to the Circuit 13 Court of the county where the licensee has his or her principal place of business or 14 where the license applicant resides. 15 Section 5. KRS 324.200 is amended to read as follows: 16 (1) If the commission determines after a hearing that any applicant is not entitled to 17 receive a license, a license shall not be granted to the applicant, and if the 18 commission determines after a hearing that any licensee has violated any of the 19 provisions of this chapter, the disciplinary measures in KRS 324.160(1) may be 20 ordered. 21 (2) Pursuant to KRS 13B.120(7), the executive director of the Kentucky Real Estate 22 Authority within the Public Protection Cabinet[Department of Professional 23 Licensing] shall hear and issue a final order regarding a decision of the commission. 24 (3) An aggrieved party may appeal a final order of the executive director pursuant to 25 KRS Chapter 13B within thirty (30) days after the issuance of the order to the 26 Circuit Court of the county where the licensee has his or her principal place of 27 UNOFFICIAL COPY 24 RS BR 1634 Page 9 of 53 XXXX 1/24/2024 4:26 PM Jacketed business or where the license applicant resides. Disciplinary action imposed by the 1 executive director shall be automatically stayed during the pendency of an appeal to 2 a circuit or appellate court, unless otherwise indicated in the final order of the 3 executive director. 4 Section 6. KRS 324.281 is amended to read as follows: 5 (1) There is hereby created the Kentucky Real Estate Commission. The Governor shall 6 appoint seven (7) persons, at least six (6) of whom, immediately prior to the date of 7 their appointment have been residents of the state for ten (10) years and whose 8 vocation for a period of at least ten (10) years shall have been that of an active real 9 estate licensee. One (1) member shall be a citizen at large who is not associated 10 with or financially interested in the practice or business regulated. The term of the 11 members of the commission shall be for three (3) years and until their successors 12 are appointed and qualify, except as provided in subsections (2) and (3) of this 13 section. A majority of the commission shall constitute a quorum for the transaction 14 of business. 15 (2) All appointments shall be for the specified three (3) year term. No person appointed 16 after July 14, 2000, shall serve more than two (2) consecutive terms. 17 (3) For each appointment or vacancy, the Kentucky Association of Realtors shall 18 within sixty (60) days supply a list of not less than three (3) names of licensees to 19 the Governor each year from which the broker or sales associate appointments shall 20 be made. The Governor may reject the list of three (3) names and request that the 21 Kentucky Association of Realtors submit a new list of three (3) names within sixty 22 (60) days of the Governor's request. If the Kentucky Association of Realtors fails to 23 timely submit this list to the Governor, the Governor may immediately appoint a 24 qualified person to fill this vacancy. The Governor may otherwise fill vacancies 25 arising in the middle of the year from those remaining on the list or from a new list 26 supplied by the association. 27 UNOFFICIAL COPY 24 RS BR 1634 Page 10 of 53 XXXX 1/24/2024 4:26 PM Jacketed (4) There shall not be more than four (4) members of any one (1) political party serving 1 on the commission at the same time. No member of the commission shall reside in 2 the same county as another member. Appointees to fill vacancies shall be appointed 3 for the unexpired term. 4 (5) It shall be the duty of the commission to: 5 (a) Promulgate administrative regulations, with the approval of the executive 6 director of the Kentucky Real Estate Authority; 7 (b) Hold disciplinary hearings concerning matters in controversy as provided by 8 this chapter; 9 (c) Conduct examinations for applicants eligible under this chapter or 10 alternatively to contract with an entity to conduct examinations; 11 (d) Conduct necessary educational seminars and courses directed toward 12 continuing education within the real estate field; 13 (e) Investigate or cause to be investigated any irregularities in violation of this 14 chapter or the promulgated and authorized administrative regulations of the 15 commission; and 16 (f) Participate with any other agency of the Commonwealth or the authorized 17 agency of another state for the betterment or improvement of the 18 administration of the statutes or administrative regulations governing this 19 commission. 20 Any action taken by the commission under this subsection shall be appealable as 21 are other actions of the commission under this chapter. 22 (6) The commission, at its discretion, may use the funds necessary to purchase liability 23 insurance for members and executive officers of the commission, inspectors, and 24 for members of the staff exempted from classified service of the state by KRS 25 18A.115. 26 (7) The commission shall require all actively licensed agents, except for those agents 27 UNOFFICIAL COPY 24 RS BR 1634 Page 11 of 53 XXXX 1/24/2024 4:26 PM Jacketed who were licensed prior to June 19, 1976, to successfully complete mandatory 1 continuing education as a condition of license renewal. 2 (8) The commission shall, by the promulgation of administrative regulations, develop a 3 review process by which continuing education courses may be approved for credit. 4 An applicant may seek the commission's approval for credit for courses not 5 previously approved by the commission by submitting sufficient information 6 describing the course to the commission for review. 7 (9) The Governor shall set the compensation of the members of the commission, but 8 voting members of the commission shall be compensated no less than three hundred 9 dollars ($300) per day for official business, subject to an annual maximum of six 10 thousand dollars ($6,000). Members shall be reimbursed for all expenses paid and 11 incurred in the discharge of official business consistent with the reimbursement 12 policy for state employees. With the approval of the executive director of the 13 Kentucky Real Estate Authority within the Public Protection Cabinet[Department 14 of Professional Licensing], commission members and commission staff may attend 15 and travel to and from meetings and events relevant to the commission or to the 16 industry the commission represents. 17 Section 7. KRS 324A.015 is amended to read as follows: 18 (1) There is created a Real Estate Appraisers Board consisting of five (5) members, two 19 (2) of whom shall be certified real estate appraisers, one (1) of whom shall 20 represent the public and shall not be associated with or financially interested in the 21 practice of real estate appraisals, and two (2) of whom shall be employed in the 22 lending industry. The board shall administer the provisions of this chapter and may 23 promulgate administrative regulations necessary to effectuate the provisions of 24 KRS 324A.010 to 324A.090. 25 (2) (a) The board members shall be appointed by the Governor. Not more than one 26 (1) board member shall be from any one (1) county within Kentucky. 27 UNOFFICIAL COPY 24 RS BR 1634 Page 12 of 53 XXXX 1/24/2024 4:26 PM Jacketed Members shall be appointed by the Governor for staggered terms of three (3) 1 years. No person shall serve more than two (2) full consecutive terms. 2 (b) Any member appointed to fill a vacancy occurring other than by expiration of 3 a term shall be appointed for the remainder of the unexpired term. 4 (c) No more than three (3) members of the same political party shall serve on the 5 board at the same time. 6 (3) The appraiser appointees to the board shall be certified and shall have engaged in 7 the appraisal of real estate in Kentucky on a continuing basis for at least ten (10) 8 years. 9 (4) A board member shall be automatically removed from the board and a vacancy 10 shall occur when: 11 (a) An appraiser member of the board ceases to be certified; 12 (b) A consumer member of the board acquires a certification as an appraiser; 13 (c) A lending industry member ceases to be employed in the lending industry; 14 (d) A board member enters a plea of guilty to, or has been found guilty of, a 15 felony and the time for appeal has passed or the judgment of conviction has 16 been finally affirmed on appeal; 17 (e) A board member ceases to be a bona fide resident of the Commonwealth of 18 Kentucky; 19 (f) A board member displays incompetence, neglect of duty, or unprofessional 20 conduct; 21 (g) A board member fails to adhere to a duly adopted code of ethics of the board. 22 Failure to adhere to this code shall be determined by official action of the 23 board; or 24 (h) A board member misses three (3) consecutive meetings or misses more than 25 twenty-five percent (25%) of the meetings held over the previous twelve (12) 26 month period. 27 UNOFFICIAL COPY 24 RS BR 1634 Page 13 of 53 XXXX 1/24/2024 4:26 PM Jacketed (5) The board shall adopt a seal with the design it prescribes, by which it shall 1 authenticate its proceedings. Copies of all records and papers in the office of the 2 board, duly certified and authenticated by the seal of the board, shall be received in 3 evidence in all courts equally and with like effect as the original. All records kept in 4 the office of the board under the authority of this chapter shall be open to public 5 inspection in accordance with KRS 61.820 to 61.884 and consistent with 6 regulations prescribed by the board. 7 (6) The Governor shall set the compensation of the members of the board, but voting 8 members of the board shall be compensated no more than three hundred dollars 9 ($300) per day for official business, subject to an annual maximum of six thousand 10 dollars ($6,000). Members shall be reimbursed for all expenses paid and incurred in 11 the discharge of official business consistent with the reimbursement policy for state 12 employees. With the approval of the executive director of the Division of Real 13 Property Boards within the Public Protection Cabinet,[Kentucky Real Estate 14 Authority within the Department of Professional Licensing,] board members and 15 board staff may attend and travel to and from meetings and events relevant to the 16 board or the industry the board represents. 17 (7) The board shall ensure that those employed to investigate grievances filed with the 18 board are state-certified general appraisers with a minimum of five (5) years of 19 experience. 20 Section 8. KRS 324A.020 is amended to read as follows: 21 The board shall have authority to promulgate administrative regulations following review 22 of[with the approval of] the executive director of the Division of Real Property 23 Boards[Kentucky Real Estate Authority], have subpoena power, hold disciplinary 24 hearings, conduct examinations, conduct educational seminars, investigate allegations of 25 wrongdoing under this chapter, seek and obtain injunctive relief to enforce the provisions 26 of KRS 324A.010 to 324A.090, provide a list of certified appraisers to the Appraisal 27 UNOFFICIAL COPY 24 RS BR 1634 Page 14 of 53 XXXX 1/24/2024 4:26 PM Jacketed Subcommittee of the Federal Financial Institutions Examination Council, and perform 1 such other functions and duties as may be necessary in carrying out the provisions of 2 KRS 324A.010 to 324A.090. 3 Section 9. KRS 324A.052 is amended to read as follows: 4 (1) Any person or organization, including the board upon its own volition, may file 5 with the board a written complaint alleging a violation of any provision of this 6 chapter. Complaints shall be filed with the board within: 7 (a) Five (5) years after the date of transmittal of the appraisal report or appraisal 8 review assignment; or 9 (b) Two (2) years after the final disposition of any judicial proceeding in which 10 the appraiser provided testimony related to the assignment, whichever expires 11 last. 12 Paragraphs (a) and (b) of this subsection shall not apply to complaints involving the 13 actions outlined in KRS 324A.050(1)(c), (d), (g), and (k). The board shall 14 investigate each complaint. 15 (2) If the investigation reveals evidence supporting the complaint, the board shall set 16 the matter for hearing in accordance with the provisions of KRS Chapter 13B 17 before fining, reprimanding, suspending, revoking, refusing to renew, or any 18 combination thereof. 19 (3) If the investigation reveals that the alleged violation did occur but was not of a 20 serious nature, the board may issue a written admonishment to the certificate holder 21 or licensee. A copy of the admonishment shall be placed in the recipient's file with 22 the board. The recipient shall have the right to file a response to the admonishment 23 within thirty (30) days of its receipt and have the response placed in the file. The 24 recipient may, alternatively, within thirty (30) days of the receipt, file a request for 25 hearing with the board. Upon receipt of this request, the board shall set aside the 26 written admonishment and set the matter for hearing in accordance with the 27 UNOFFICIAL COPY 24 RS BR 1634 Page 15 of 53 XXXX 1/24/2024 4:26 PM Jacketed provisions of KRS Chapter 13B. 1 (4) After denying an application for a certificate or license or issuing an admonishment, 2 the board shall grant an administrative hearing in accordance with KRS Chapter 3 13B only upon written request of the applicant made within thirty (30) days of the 4 mailing of the letter of denial or admonishment. 5 (5) Pursuant to KRS 13B.120(7), the executive director of the Division of Real 6 Property Boards within the Public Protection Cabinet[Kentucky Real Estate 7 Authority within the Department of Professional Licensing] shall hear and issue a 8 final order regarding a decision of the board. An aggrieved party may appeal a final 9 order of the executive director pursuant to KRS Chapter 13B within thirty (30) days 10 after the issuance of the order to the Circuit Court of the county where the licensee 11 has his or her principal place of business or where the license applicant resides. 12 Section 10. KRS 324A.154 is amended to read as follows: 13 The board shall promulgate administrative regulations, following review of[with the 14 approval] of the executive director of the Division of Real Property Boards[Kentucky 15 Real Estate Authority], establishing a reasonable filing fee to be paid by each appraisal 16 management company seeking registration under KRS 324A.152. The filing fee shall 17 include the annual fee for inclusion in the national registry maintained by the Appraisal 18 Subcommittee of the Federal Financial Institutions Examination Council. 19 Section 11. KRS 324B.050 is amended to read as follows: 20 (1) The Kentucky Real Estate Authority is hereby created within the Public Protection 21 Cabinet[Department of Professional Licensing]. 22 (2) The authority shall be managed by an executive director, who shall be appointed by 23 the secretary of the Public Protection Cabinet with prior written approval from the 24 Governor. The executive director shall be exempted from the classified service. 25 (3) The authority shall have the power and authority to: 26 (a) Provide appropriate attorneys, personnel staffing, and administrative support 27 UNOFFICIAL COPY 24 RS BR 1634 Page 16 of 53 XXXX 1/24/2024 4:26 PM Jacketed to the Kentucky Real Estate Commission[real property boards]; 1 (b) Establish and maintain an office, meeting space, office supplies, furniture, 2 storage space, and any other supplies that are necessary to carry out the duties 3 of the authority and the Kentucky Real Estate Commission[real property 4 boards]; 5 (c) Make available for public inspection all decisions, opinions, and 6 interpretations formulated or used by the authority and the Kentucky Real 7 Estate Commission[real property boards] in discharging its[their] functions; 8 (d) Publicize the functions and purposes of the authority and the Kentucky Real 9 Estate Commission[real property boards]; 10 (e) Employ an administrative coordinator[ administrative coordinators] who 11 shall carry out the administrative functions and day-to-day operations of the 12 Kentucky Real Estate Commission. The administrative coordinator shall be 13 exempted from the classified service; and[real property boards. The 14 maximum number of administrative coordinators shall be one (1) for each real 15 property board. administrative coordinators shall be exempted from the 16 classified service;] 17 (f) Enter into agreements with any state agency, political subdivision of the state, 18 postsecondary education institution, or other person or entity to assist with 19 implementation of the duties and responsibilities of the authority or, upon 20 request, the Kentucky Real Estate Commission[real property boards; and 21 (g) Charge the real property boards a reasonable amount for the services of the 22 authority and its employees]. 23 Section 12. KRS 324B.030 is amended to read as follows: 24 (1) The Department of Professional Licensing in the Public Protection Cabinet shall 25 provide administrative services, technical assistance, and advice to the following 26 boards and commissions at the request of the individual boards or commissions, all 27 UNOFFICIAL COPY 24 RS BR 1634 Page 17 of 53 XXXX 1/24/2024 4:26 PM Jacketed of which maintain their identity and their full authority for making policy decisions 1 in the fields that they regulate: the State Board of Accountancy, the Kentucky 2 Board of Architects, the Kentucky Board of Barbering, the Kentucky Board of 3 Cosmetology, the State Board of Podiatry, the Kentucky State Board of 4 Chiropractic Examiners, the Kentucky Board of Dentistry, the State Board of 5 Embalmers and Funeral Directors, the State Board of Registration for Professional 6 Engineers and Land Surveyors, the Kentucky Board of Nursing, the Kentucky 7 Board of Ophthalmic Dispensers, the Kentucky Board of Optometric Examiners, 8 the Kentucky Board of Pharmacy, the State Board of Physical Therapy, the State 9 Board of Examiners of Psychologists[, the Kentucky Real Estate Commission], the 10 Kentucky Board of Veterinary Examiners[, the Board of Auctioneers], the 11 Kentucky Board of Landscape Architects, the State Board of Medical Licensure, 12 the Board of Speech-Language Pathology and Audiology, the Kentucky Board of 13 Licensure for Nursing Home Administrators, the Kentucky Licensing Board for 14 Specialists in Hearing Instruments, the Kentucky Board of Social Work, the 15 Kentucky Board of Emergency Medical Services, and any other boards and 16 commissions that are created to license, certify, register, or otherwise regulate any 17 occupational or professional category. 18 (2) The department may also provide administrative services to a board or commission 19 that is created to license, certify, register, or otherwise regulate any occupational or 20 professional category if these administrative services are deemed to be preferable or 21 required after the review process conducted under KRS 324B.040. 22 (3) To the extent that the department provides administrative services, the respective 23 boards and commissions are relieved of the power and duty to provide the services 24 for themselves. The department shall charge each board or commission a reasonable 25 amount for administrative services provided pursuant to subsection (1) of this 26 section. The department may employ persons previously employed by boards or 27 UNOFFICIAL COPY 24 RS BR 1634 Page 18 of 53 XXXX 1/24/2024 4:26 PM Jacketed commissions. 1 (4) The department may receive complaints against the conduct of licensees granted 2 licensure by the boards and commissions assigned to the department for 3 administrative purposes. The department shall cause these complaints to be reduced 4 to writing and forwarded to the appropriate board or commission for investigation 5 and a determination of the validity of the complaint. The department shall keep a 6 record of all complaints received by it and forwarded to a board or commission. 7 (5) Any board or commission listed in subsection (1) of this section, shall accept 8 personal checks in payment of license renewal fees. 9 Section 13. KRS 324B.060 is amended to read as follows: 10 The executive director shall: 11 (1) Provide government oversight of the Kentucky Real Estate Commission[real 12 property boards]; 13 (2) Review and provide feedback on[approve or disapprove] any administrative 14 regulation proposed by the Kentucky Real Estate Commission[real property 15 boards] prior to the promulgation of the administrative regulation; 16 (3) Review and provide feedback on[approve or disapprove] the budgets and 17 expenditures of the Kentucky Real Estate Commission[real property boards]; 18 (4) Pursuant to KRS 13B.120(7), automatically hear and issue a final order regarding 19 any decision of the Kentucky Real Estate Commission[a real property board] that 20 would otherwise be subject to appeal. An aggrieved party may appeal a final order 21 of the executive director pursuant to KRS Chapter 13B within thirty (30) days after 22 the issuance of the order to the Circuit Court of the county where the licensee has 23 his or her principal place of business or where the license applicant resides; 24 (5) Make available for public inspection all decisions, opinions, and interpretations 25 formulated or used by the executive director in discharging his or her functions; 26 (6) Carry out the policy and program directives of the authority[department]; 27 UNOFFICIAL COPY 24 RS BR 1634 Page 19 of 53 XXXX 1/24/2024 4:26 PM Jacketed (7) Prepare annual reports on the executive director's activities; 1 (8) Delegate any power to employees and contractors as needed; 2 (9) Have at least ten (10) years of experience in real estate brokerage[one (1) of the 3 professions under the jurisdiction of a real property board]; and 4 (10) Perform all other duties assigned by law. 5 Section 14. KRS 330.050 is amended to read as follows: 6 (1) There is hereby created a Board of Auctioneers. The Governor shall appoint a board 7 consisting of five (5) members, all of whom immediately prior to the date of their 8 appointment have been residents of the Commonwealth of Kentucky for five (5) 9 years, and four (4) whose vocation for a period of at least five (5) years has been 10 that of an auctioneer. One (1) member shall be a citizen at large who is not 11 associated with or financially interested in the practice or business regulated. The 12 term of the members of the board shall be for three (3) years and until their 13 successors are appointed and qualified. Members to fill vacancies shall be 14 appointed for the unexpired term. 15 (2) At no time shall there be more than two (2) auctioneer members of the same 16 political party on the board. Whenever there is an auctioneer vacancy on the board, 17 within sixty (60) days the Kentucky Auctioneer Association shall recommend to the 18 Governor at least three (3) names for each auctioneer vacancy, and such 19 appointment or appointments shall be made from the recommendations of the 20 association, unless the Governor rejects the list of three (3) names and requests that 21 the Kentucky Auctioneer Association submit a new list of three (3) names within 22 sixty (60) days of the Governor's request. If the Kentucky Auctioneer Association 23 fails to timely submit its recommendations to the Governor, the Governor may 24 immediately appoint a qualified auctioneer to fill this vacancy. 25 (3) The board, immediately upon qualification of the member appointed in each year, 26 shall organize by selecting from its members a chairman. 27 UNOFFICIAL COPY 24 RS BR 1634 Page 20 of 53 XXXX 1/24/2024 4:26 PM Jacketed (4) (a) No member of the board shall reside in the same county as another member. 1 (b) A majority of the board shall constitute a quorum for the transaction of 2 business. 3 (c) No member may serve on the board for more than six (6) consecutive years. A 4 member may serve on the board for six (6) consecutive years on more than 5 one (1) occasion if that person is not a member of the board for at least two 6 (2) years between periods of board service. 7 (5) (a) The board shall obtain office space, furniture, stationery, and any other proper 8 supplies and conveniences reasonably necessary to carry out the provisions of 9 this chapter. If any items deemed to be reasonably necessary by or which are 10 required by the board are available through vendors under contract with the 11 Commonwealth of Kentucky at less cost than if obtained otherwise, then the 12 items shall be acquired pursuant to the contract. 13 (b) The board shall have full authority to obtain for its members, staff, and 14 employees complete insurance coverage, including, but not limited to, liability 15 and errors and omissions insurance, so long as the insurance concerns the 16 business of the board. 17 (6) All fees and charges collected by the board under the provisions of this chapter 18 shall be paid into the State Treasury through the Finance and Administration 19 Cabinet and shall be credited to an agency fund account for the Board of 20 Auctioneers under the provisions of KRS 45.253 and shall be withdrawn or 21 expended as provided in that section, if such payment, credit, withdrawal, or 22 expense provisions do not conflict with any provision of this chapter. 23 (a) The board may establish and collect reasonable fees relating to the 24 administration and enforcement of this chapter for application or other 25 processing costs, on-line service, continuing education provider services, copy 26 and mailing services, or other fees necessary to offset the licensing and 27 UNOFFICIAL COPY 24 RS BR 1634 Page 21 of 53 XXXX 1/24/2024 4:26 PM Jacketed processing costs. 1 (b) The total expenses for all purposes and obligations of the board shall not 2 exceed the total fees, charges, fines, penalties, and other income imposed 3 under the provisions of this chapter and paid into the state treasury. 4 (c) The board shall be financially self-sustaining, and if funds permit it may 5 underwrite, within its financial limitations, educational programs for the 6 enlightenment and benefit of all licensees who have paid fees pursuant to this 7 chapter. 8 (7) The board shall maintain annually a list of the names and addresses of all licensees 9 regulated by the board. This list shall also contain the names of all persons whose 10 licenses have been suspended or revoked within the preceding year, as well as any 11 other information relative to the enforcement of the provisions of this chapter that 12 the board may deem of interest to the public. 13 (8) The board may promulgate administrative regulations following review of[with the 14 approval of] the executive director of the Division of Real Property Boards within 15 the Public Protection Cabinet[Kentucky Real Estate Authority] in accordance with 16 KRS Chapter 13A as required to fulfill the duties and functions assigned to the 17 board by this chapter. 18 (9) A board member shall be automatically removed from the board and a vacancy 19 shall occur when: 20 (a) An auctioneer member of the board ceases to be a licensed auctioneer; 21 (b) A nonlicensed member of the board acquires a license regulated by the board; 22 (c) A board member enters a plea of guilty, an Alford plea, a plea of no contest 23 to, or has been convicted of, any felony, and the time for appeal has passed or 24 the judgment of conviction has been finally affirmed on appeal; 25 (d) A board member ceases to be a resident of the Commonwealth of Kentucky; 26 (e) The member displays incompetence, neglect of duty, or unprofessional 27 UNOFFICIAL COPY 24 RS BR 1634 Page 22 of 53 XXXX 1/24/2024 4:26 PM Jacketed conduct; 1 (f) The member fails to adhere to a duly adopted code of ethics of the board. 2 Failure to adhere to this code shall be determined by official action of the 3 board; 4 (g) The member enters a plea of guilty to, or has been found guilty of, a felony 5 and the time for appeal has passed or the judgment of conviction has been 6 finally affirmed on appeal; or 7 (h) The member misses three (3) consecutive meetings or misses more than 8 twenty-five percent (25%) of the meetings held over the previous twelve (12) 9 month period. 10 (10) The Governor shall set the compensation of the members of the board, but voting 11 members of the board shall be compensated no less than three hundred dollars 12 ($300) per day for official business, subject to an annual maximum of six thousand 13 dollars ($6,000). Members shall be reimbursed for all expenses paid and incurred in 14 the discharge of official business consistent with the reimbursement policy for state 15 employees. With the approval of the executive director of the Kentucky Real Estate 16 Authority within the Department of Professional Licensing, board members and 17 board staff may attend and travel to and from meetings and events relevant to the 18 board and the industry the board represents. 19 Section 15. KRS 330.130 is amended to read as follows: 20 (1) Before denying an application for license or before imposing any disciplinary 21 action authorized under KRS 330.110, the board shall set the matter for an 22 administrative hearing, if a hearing is requested by the applicant or licensee. The 23 hearing shall be conducted in accordance with KRS Chapter 13B. If the subject of 24 the hearing is an apprentice auctioneer, the board shall also provide notification of 25 the hearing to the auctioneer employing the apprentice auctioneer or whose employ 26 he or she is about to enter, by sending notice by certified mail, return receipt 27 UNOFFICIAL COPY 24 RS BR 1634 Page 23 of 53 XXXX 1/24/2024 4:26 PM Jacketed requested, to the auctioneer's last known business address. 1 (2) Pursuant to KRS 13B.120(7), the executive director of the Division of Real 2 Property Boards within the Public Protection Cabinet[Kentucky Real Estate 3 Authority within the Department of Professional Licensing] shall hear and issue a 4 final order regarding a decision of the board. 5 (3) An aggrieved party may appeal a final order of the executive director pursuant to 6 KRS Chapter 13B within thirty (30) days after the issuance of the order to the 7 Circuit Court of the county where the licensee has his or her principal place of 8 business or where the license applicant resides. 9 Section 16.
