AN ACT relating to the right to refuse medical treatment. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 311 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) The General Assembly recognizes that the right to refuse any medical procedure, 5
treatment, injection, vaccine, prophylactic, pharmaceutical, or medical device is 6
the inherent and absolute right of all competent adults to direct their own 7
healthcare decisions. 8
(2) A person, employer, entity, or health care provider shall not require, mandate, or 9
coerce a competent adult to receive or use a medical procedure, treatment, 10
injection, vaccine, prophylactic, pharmaceutical, or medical device. 11
(3) A person, employer, entity, or health care provider that requires, mandates, or 12
coerces a competent adult, or the legal guardian of an adult with disabilities, to 13
receive or use a medical procedure, treatment, injection, vaccine, prophylactic, 14
pharmaceutical, or medical device shall not be entitled to any liability protections 15
in the event that the competent adult or an adult with disabilities, develops a 16
serious adverse reaction as a result of the requirement, mandate, or coercion. 17
Any state law granting liability protections to a person, employer, entity, or health 18
care provider is null and void. 19
