AN ACT relating to utility service disconnection reports by retail electric suppliers. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 278 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) On or before the fifteenth day of each month, every retail electric supplier shall 5
file a retail electric service disconnection report with the commission detailing all 6
service disconnections for their residential customers that occurred during the 7
previous calendar month by date, time of disconnection, and reason for 8
disconnection. The report shall show disconnections as a proportion of the total 9
number of residential accounts for the reporting period. 10
(2) The retail electric service disconnection report shall include the reasons for each 11
disconnection, including but not limited to disconnection based on: 12
(a) A customer's request for discontinuance or transfer service; 13
(b) Nonpayment of bills, including noncompliance with a deferred payment 14
plan or nonpayment of deposit; or 15
(c) Violation of a retail electric supplier's terms of service or using the service 16
in a manner which interferes with other customers. 17
(3) Each retail service disconnection shall show: 18
(a) The high and low recorded temperature issued by the National Oceanic and 19
Atmospheric Administration, National Weather Service for the retail service 20
disconnection date and location; and 21
(b) Whether the retail electric service was reconnected, if the reconnection was 22
within twenty-four (24) hours of service the disconnection. 23
(4) The monthly retail electric service disconnection report shall be made available to 24
the public on the commission's website. 25
