A NEW SECTION OF KRS CHAPTER 246 IS CREATED TO 4 READ AS FOLLOWS: 5 The Government Resources Accelerating Needed Transformation Program of 2024 is 6 intended exclusively for the federal grants identified by the Interagency Working 7 Group on Coal and Power Plant Communities and Economic Revitalization 8 established by Presidential Executive Order 14008, issued on January 27, 2021. 9 SECTION 2. A NEW SECTION OF KRS CHAPTER 246 IS CREATED TO 10 READ AS FOLLOWS: 11 As used in Sections 1 to 8 of this Act: 12 (1) "Commission" means the GRANT Commission established in Section 8 of this 13 Act. 14 (2) "County population ranking" means the score of each county determined by 15 department under subsection (7) of Section 5 of this Act; 16 (3) "Department" means the Department of Agriculture; 17 (4) "Eligible grant recipient" means a grant applicant that is a county or city 18 governing body or nonprofit charitable organization organized under 26 U.S.C. 19 sec. 501(c)(3) and engaged in public benefit improvements; 20 (5) "Eligible project" means a project that: 21 (a) Benefits the public or substantially benefits the public and satisfies the 22 evaluation criteria in Section 5 of this Act and that is initiated on: 23 1. Publicly owned property; 24 2. Property to be acquired, which comes with either a: 25 a. Legally binding sale agreement for the sale to an eligible grant 1 recipient; or 2 3. Private property on which a project is located that is in the public 3 interest and for a public purpose and that benefits an eligible 4 community; and 5 (b) Requires local matching funds based on the county population ranking as 6 provided in Section 5 of this Act; 7 (6) "Eligible use" means the authorized purpose for which an awarded grant may be 8 used depending on the source of funds from the Commonwealth; 9 (7) "Interagency Working Group" means the Interagency Working Group on Coal 10 and Power Plant Communities and Economic Revitalization established by 11 Presidential Executive Order 14008, issued on January 27, 2021; 12 (8) "Population density": 13 (a) Means the number of persons per square mile of a county; 14 (b) Is calculated by dividing the total county population by the square miles in 15 the county; 16 (c) Is determined by using the population estimate from the most recent 17 available five (5) year American Community Survey as published by the 18 United States Census Bureau; and 19 (d) Is used to rank each county in descending order, with the county having the 20 largest population density receiving a rank of one (1) and the county with 21 the smallest population density receiving a rank of one hundred twenty 22 (120); 23 (9) "Regional project" means an eligible project that is proposed by eligible grant 24 recipients residing or having a primary business address in different counties in 25 this Commonwealth who submit a single grant application; and 26 (10) "Ten (10) year percentage change in population": 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 3 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA (a) Means the percentage change in population within a county; 1 (b) Is determined by comparing the population estimate from the most recent 2 available five (5) year American Community Survey as published by the 3 United States Census Bureau to the same survey ten (10) years prior to the 4 most recent available survey; and 5 (c) Is used to rank each county in descending order, with the county having the 6 largest positive percentage change in population receiving a rank of one (1) 7 and the county with the largest negative percentage change receiving a rank 8 of one hundred twenty (120). 9 SECTION 3. A NEW SECTION OF KRS CHAPTER 246 IS CREATED TO 10 READ AS FOLLOWS: 11 (1) The Government Resources Accelerating Needed Transformation Program of 12 2024 is hereby established under the department, subject to the approval of the 13 commission established in Section 8 of this Act. The department's administration 14 of the program includes but is not limited to the following: 15 (a) Creating and making available a standardized grant application and a 16 regional grant application for the obligation of state funds under Sections 1 17 to 8 of this Act to apply for matching federal funds; 18 (b) Developing a standardized scoring system pursuant to this section and 19 Section 5 of this Act; 20 (c) Reviewing and processing the applications submitted by the proposed 21 eligible grant recipients to the department; 22 (d) Verifying and determining whether a match applicant is an eligible grant 23 recipient that is seeking a federal grant for an eligible project; 24 (e) Evaluating the project proposed by the match application in accordance 25 with the evaluation criteria set forth in this section and Section 5 of this 26 Act; 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 4 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA (f) Scoring each match application pursuant to the scoring system described in 1 Section 5 of this Act; 2 (g) Ranking each match application: 3 1. To prioritize the greatest return on investment and relative positive 4 impact of the eligible project; and 5 2. Based on the project evaluation and the project score described in this 6 section and Section 5 of this Act; 7 (h) Compiling a list of proposed match applicants whose eligible project 8 demonstrates a high level of investment potential if a match is provided, as 9 revealed by the evaluation, scoring, and ranking process described in this 10 section and Section 5 of this Act; 11 (i) Providing detailed feedback to the match applicants after the project 12 evaluation and project score are completed and the match application is 13 approved or denied by the department, unless otherwise prohibited by 14 federal or state law; 15 (j) Obligating matching funds to selected eligible grant recipients; 16 (k) Compiling the monthly report to be submitted under Section 7 of this Act; 17 and 18 (l) Compiling the annual report to be submitted under Section 7 of this Act. 19 (2) The department shall determine the terms, conditions, and requirements of 20 application for match funds awarded from the Government Resources 21 Accelerating Needed Transformation Program of 2024 fund. The department 22 may establish procedures and standards for the review and approval of obligation 23 of match funds through the promulgation of administrative regulations in 24 accordance with KRS Chapter 13A. By December 1, 2024, the department shall 25 submit recommended legislative changes to the Legislative Research Commission 26 for referral to and for consideration by the Senate Standing Committee on 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 5 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA Appropriations and Revenue, and the House Standing Committee on 1 Appropriations and Revenue or the Interim Joint Committee on Appropriations 2 and Revenue. 3 (3) The commissioner of the department shall have the authority to hire staff, 4 contract for services, expend funds, and operate the normal business activities of 5 the Government Resources Accelerating Needed Transformation Program of 6 2024. Notwithstanding KRS Chapter 45A, the department may contract with a 7 third party for implementation and administration of the program. 8 (4) The Government Resources Accelerating Needed Transformation Program of 9 2024 as provided in Sections 1 to 8 of this Act shall sunset on December 31, 2026, 10 unless authorized by the General Assembly to continue its work for a specified 11 period of time. 12 (5) The Kentucky Council of Area Development Districts and local area development 13 districts shall assist eligible grant recipients in identifying available federal grant 14 opportunities and preparing federal grant applications and Government 15 Resources Accelerating Needed Transformation Program of 2024 applications. 16 Nothing in this subsection shall prevent any public agency or nonprofit entity 17 from assisting eligible grant recipients in identifying available federal grant 18 opportunities and preparing federal grant applications and Government 19 Resources Accelerating Needed Transformation Program of 2024 applications. 20 (6) Upon request of the local area development districts, a local public institution in 21 the postsecondary education system as defined in KRS 164.001 shall assist the 22 eligible grant recipients in their area by including but not limited to: 23 (a) Identifying opportunities for federal grants; 24 (b) Rendering supplemental support for federal grant applications on behalf of 25 the communities including but not limited to providing data and analysis for 26 the federal grant application; or 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 6 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA (c) Acting as the contact person for the local public institution to the Kentucky 1 Council of Area Development Districts and to the area development district 2 in which the local public institution is located and updating the contact 3 person information. 4 SECTION 4. A NEW SECTION OF KRS CHAPTER 246 IS CREATED TO 5 READ AS FOLLOWS: 6 (1) (a) To participate in the Government Resources Accelerating Needed 7 Transformation Program of 2024, grant applicants shall submit either a 8 standardized or a regional application to the department for consideration 9 by the commission. 10 (b) The department shall provide a preliminary evaluation of the application 11 within five (5) business days of receipt of the application. As part of the 12 preliminary evaluation, the department shall consider the following: 13 1. Applicant's eligibility when evaluated against the requirements of the 14 federal grant; and 15 2. Application completeness when evaluated against the requirements of 16 the federal grant. 17 (c) The department shall provide a final decision of approval or denial on the 18 application within twenty-one (21) calendar days of receipt of the 19 application. 20 (2) If a grant application is selected as an eligible match recipient approved under 21 Sections 1 to 8 of this Act, it shall comply with any match agreement and 22 reporting requirements deemed necessary by the department to verify that the 23 awarded funds to go toward an eligible use. 24 (3) If the selected match recipient fails to comply with subsection (2) of this section 25 or uses the awarded match money for any purpose other than an eligible use, the 26 selected eligible match recipient shall forfeit and be liable to the department for 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 7 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA the full award amount. 1 SECTION 5. A NEW SECTION OF KRS CHAPTER 246 IS CREATED TO 2 READ AS FOLLOWS: 3 (1) The department shall identify and certify the areas for grant funding designated 4 by the Interagency Working Group as a priority for obligation of match funds. 5 Any area in Kentucky that is eligible for federal grant resources, but is not an 6 Interagency Working Group designated community, may be eligible for 7 obligation of state funds under this section. The department shall not approve a 8 project unless it finds that the project is in the public interest and the grant funds 9 will be used for a public purpose. For purposes of this subsection, projects that 10 are in the public interest and for a public purpose can include a derivative private 11 benefit, if the department finds the following: 12 (a) The project will enhance a community or region; 13 (b) The granting entity for which the department's matching grant is being 14 used requires a public purpose for grant eligibility; or 15 (c) The department in its judgment concludes the proposal will enhance the 16 quality of life or services in a community or region. 17 (2) The department shall evaluate each applicant's eligible project according to the 18 criteria described in this section for the purpose of compiling a recommendation 19 and score for the eligible project pursuant to this section. 20 (3) If a match applicant is selected as an eligible grant recipient approved under the 21 Government Resources Accelerating Needed Transformation Program of 2024, it 22 shall comply with any incentive agreements and reporting requirements deemed 23 necessary by the department to verify that the awarded grant shall go toward an 24 eligible use. 25 (4) In the administration of the Government Resources Accelerating Needed 26 Transformation Program of 2024, the department shall develop a scoring system 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 8 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA for the project proposed by each match applicant based on the total projected 1 return on investment and the relative positive impact in the community. 2 (5) The scoring system shall include a: 3 (a) Score in each category as specified in subsection (6) of this section; and 4 (b) Total weighted score, which is the average of the scores in each category. 5 (6) The scoring categories shall include but are not limited to: 6 (a) Projected return on investment the project will yield, which includes an 7 assessment of the: 8 1. Likelihood of project completion both with the department's funding 9 and without; 10 2. Application content when evaluated against the federal grant 11 program's publicly available scoring rubric or evaluation criteria, if 12 any; 13 3. Projected gross economic impact of the proposed project on the 14 community; 15 4. Projected number of jobs created by the proposed project and 16 subsequent impact on the community; 17 5. Determination of the cost of the project based on the cost expended by 18 the department if it obligates the requested grant amount to the 19 applicant; 20 6. Evidence of community support for the project; 21 7. Likelihood that the applicant can successfully manage the federal 22 grant's administration requirements; and 23 8. Likelihood of success based on a federal agency prioritization of a 24 particular applicant; and 25 (b) Overall positive impact the project will have on the surrounding community 26 as evidenced by clear and feasible projected outcomes of the grant-funded 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 9 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA project. 1 (7) (a) On or before May 1, 2024, and not later than May 1 every two (2) years 2 thereafter, the department shall determine a county population ranking for 3 each county by adding the following two (2) factors: 4 1. The population density ranking; and 5 2. The ten (10) year percentage change in population ranking. 6 (b) The required local match for each county shall be as follows: 7 1. Eligible projects in counties where the county population ranking is 8 greater than or equal to one hundred ninety-three (193) shall provide 9 a minimum amount of local matching funds equal to one percent (1%) 10 of the state match; 11 2. Eligible project in counties where the county population ranking is 12 less than one hundred ninety-three (193) but greater than or equal to 13 one hundred forty-five (145) shall provide a minimum amount of local 14 matching funds equal to two percent (2%) of the state match; 15 3. Eligible project in counties where the county population ranking is 16 less than one hundred forty-five (145) but greater than or equal to 17 ninety-seven (97) shall provide a minimum amount of local matching 18 funds equal to three percent (3%) of the state match; 19 4. Eligible project in counties where the county population ranking is 20 less than ninety-seven (97) but greater than or equal to forty-nine (49) 21 shall provide a minimum amount of local matching funds equal to 22 four percent (4%) of the state match; and 23 5. Eligible project in counties where the county population ranking is 24 less than forty-nine (49) shall provide a minimum amount of local 25 matching funds equal to five percent (5%) of the state match. 26 (c) On or before November 1, 2024, and no later than November 1 every two (2) 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 10 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA years thereafter, the department shall report to the Legislative Research 1 Commission and the Interim Joint Committee on Appropriation and 2 Revenue the following information for each county: 3 1. The county name; 4 2. The population density ranking for that county; 5 3. The ten (10) year percentage change in population ranking for that 6 county; and 7 4. The county population ranking for that county. 8 (8) (a) For selected eligible grant recipients that are involved in a regional project, 9 the cabinet may pool the potential allocation of funds available for each 10 county represented by the eligible grant recipients for the grant amount 11 awarded. 12 (b) A county that is an eligible grant recipient involved in a regional project 13 shall provide that county's local matching funds based on the county 14 population ranking determined under subsection (7) of this section and 15 each county's local matching funds may be pooled as described in 16 paragraph (a) of this subsection. 17 (9) Beginning no later than November 1, 2024, and annually thereafter until the 18 authorized appropriation is spent or returned, the department shall compile and 19 submit a report for each application approved by the GRANT Commission 20 established in Section 8 of this Act for the for the Government Resources 21 Accelerating Needed Transformation Program of 2024. The report shall be 22 electronically delivered to the Legislative Research Commission and the Interim 23 Joint Committee on Appropriations and Revenue and contain the following 24 information: 25 (a) The name of the applicant, a description of the eligible project, and the 26 location of each proposed project for which an application was approved; 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 11 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA (b) The date the application was approved by the GRANT Commission; 1 (c) The amount of funding authorized for each project approved; 2 (d) The total amount of funding disbursed for each project approved; and 3 (e) The round of funding for which each project received approval. 4 (10) The Government Resources Accelerating Needed Transformation Program of 5 2024 shall begin April 15, 2024. The department shall begin accepting 6 applications for the program on May 15, 2024. 7 SECTION 6. A NEW SECTION OF KRS CHAPTER 246 IS CREATED TO 8 READ AS FOLLOWS: 9 (1) There is hereby established in the State Treasury a trust and agency account to be 10 known as the Government Resources Accelerating Needed Transformation 11 Program of 2024 fund. The fund shall consist of moneys received from state 12 appropriations, gifts, grants, and federal funds. 13 (2) The fund shall be administered and maintained by the department. 14 (3) Amounts deposited in the fund shall be used for awarding: 15 (a) Matching funds to applicants of the Government Resources Accelerating 16 Needed Transformation Program of 2024 upon notification of award of the 17 federal grant requiring matching funds. Up to twenty percent (20%) of the 18 amounts deposited in the fund shall be used for match awards for nonprofit 19 charitable organizations organized under 26 U.S.C. sec. 501(c)(3); and 20 (b) Matching funds to applicants of the Government Resources Accelerating 21 Needed Transformation Program of 2024 upon notification of award of the 22 federal grant requiring matching funds. Up to eighty percent (80%) of the 23 amounts deposited in the fund shall be used for match awards to county or 24 city governing bodies. 25 (4) Notwithstanding KRS 45.229, moneys in the account not expended at the close of 26 a fiscal year shall not lapse but shall be carried forward into the next fiscal year. 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 12 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA (5) Any interest earnings of the fund shall become a part of the fund and shall not 1 lapse. 2 (6) Moneys deposited in the fund are hereby appropriated for the purposes set forth 3 in this section and shall not be appropriated or transferred by the General 4 Assembly for any other purposes. 5 (7) Any match funds awarded under subsection (3) of this section shall be canceled 6 upon denial of the federal award. 7 (8) On or after June 30, 2024, any unencumbered moneys in the fund established in 8 Section 10 of this Act, shall be transferred to the Government Resources 9 Accelerating Needed Transformation Program of 2024 fund administered by the 10 Department of Agriculture created in this section. 11 SECTION 7. A NEW SECTION OF KRS CHAPTER 246 IS CREATED TO 12 READ AS FOLLOWS: 13 (1) (a) By June 1, 2024, the department shall submit a monthly report on eligible 14 project applications to the Governor and the Senate Standing Committee on 15 Appropriations and Revenue and the House Standing Committee on 16 Appropriations and Revenue, or the Interim Joint Committee on 17 Appropriations and Revenue, and make the reports available on the 18 department's website. 19 (b) The monthly report shall be a summary of the eligible project applications 20 and shall include but not be limited to the following; 21 1. A list of all match applicants; 22 2. The identity of applicants who were not selected for obligation of 23 match funds; 24 3. Trends found in feedback given to applicants who were not selected 25 for obligation of match funds; 26 4. Eligible uses of the projects cited in the match applications; 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 13 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA 5. The date of the application; 1 6. The date of receipt of the application by the department; 2 7. A description of the federal grant funds applied for by the applicant; 3 8. A description of the title, subject matter, preliminary evaluation, and 4 scoring tally of the eligible project; 5 9. The date of the department's preliminary evaluation; 6 10. The amount of moneys requested, and the amount of moneys approved 7 or denied for each application; 8 11. The date of the department's final decision on obligation of the match 9 funds, the date of the federal grant approval or denial, and whether 10 the eligible project was approved or denied; and 11 12. Any other information requested by the department. 12 (2) By November 1, 2024, and annually thereafter until November 1, 2026, the 13 department shall prepare an annual report of the Government Resources 14 Accelerating Needed Transformation Program of 2024 to be submitted to the 15 Governor and the Interim Joint Committee on Appropriations and Revenue and 16 made available on the department's website. The annual report shall include but 17 not be limited to the following: 18 (a) A summary of the monthly reports and the match applications received and 19 relevant statistics relating to actions taken by the department and grants 20 awarded, including the applicant, award amount, and the purpose of the 21 funding; 22 (b) The current balance of the Government Resources Accelerating Needed 23 Transformation Program of 2024 fund; 24 (c) Recommendations regarding appropriations to the Government Resources 25 Accelerating Needed Transformation Program of 2024 fund for the 26 upcoming fiscal year; and 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 14 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA (d) Recommendations for legislation or policy actions needed to facilitate 1 greater receipt of grant funding to eligible grant recipients. 2 SECTION 8. A NEW SECTION OF KRS CHAPTER 246 IS CREATED TO 3 READ AS FOLLOWS: 4 (1) There is hereby established the GRANT Commission. The commission shall be 5 administratively attached to the Department of Agriculture. 6 (2) (a) The commission shall consist of the following seven (7) voting members: 7 1. The Attorney General or his or her designee; 8 2. The Auditor of Public Accounts or his or her designee; 9 3. The Commissioner of Agriculture or his or her designee; 10 4. The Secretary of State of his or her designee; 11 5. The State Treasurer or his or her designee; and 12 6 Two (2) members appointed by the Governor. 13 (b) Each member appointed by the Governor shall serve for a term of four (4) 14 years, except that in making the initial appointments, the Governor shall 15 appoint two (2) members to serve for two (2) years. All succeeding 16 appointments shall be for a term of four (4) years. 17 (3) The commission shall elect the chair and vice chair from its membership every 18 two (2) years. In the absence or vacancy of the chair, the vice chair shall serve as 19 chair. 20 (4) All members shall be registered voters of Kentucky. 21 (5) (a) Meetings of the commission shall be conducted according to KRS 61.805 to 22 61.850. 23 (b) The commission shall meet at least twice within each calendar year. 24 (c) Four (4) voting members of the commission shall constitute a quorum for 25 the transaction of business. 26 (d) Each member of the commission shall have one (1) vote, with all actions 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 15 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA being taken by an affirmative vote of the majority of members present. 1 (6) The department shall provide staff and support services to the commission and 2 shall direct and supervise its administrative affairs and general management 3 subject to the policies, control, and direction of the commission. 4 (7) Notwithstanding KRS 12.028, the commission shall not be subject to 5 reorganization by the Governor. 6 Section 9. KRS 147A.154 is amended to read as follows: 7 (1) The Government Resources Accelerating Needed Transformation Program is 8 hereby established under the department. The department's administration of the 9 program includes but is not limited to the following: 10 (a) Creating and making available a standardized grant application and a regional 11 grant application; 12 (b) Developing a standardized scoring system pursuant to KRS 147A.162; 13 (c) Reviewing and processing the applications and proposals submitted by the 14 proposed grant recipients; 15 (d) Verifying and determining whether a grant applicant is an eligible grant 16 recipient and seeking a grant for an eligible project; 17 (e) Evaluating the project proposed by the grant application in accordance with 18 the evaluation criteria set forth in KRS 147A.160; 19 (f) Scoring each grant application project pursuant to the scoring system 20 described in KRS 147A.162; 21 (g) Ranking each grant application: 22 1. To prioritize the greatest return on investment and relative positive 23 impact on the priority community; and 24 2. Based on the project evaluation and the project score described in KRS 25 147A.160 and 147A.162; 26 (h) Compiling a list of proposed grant recipients whose eligible project 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 16 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA demonstrates a high level of investment potential if a grant is made, as 1 revealed by the evaluation, scoring, and ranking process described in this 2 section and KRS 147A.160 and 147A.162; 3 (i) Providing detailed feedback to the grant applicants after the project evaluation 4 and project score are completed; 5 (j) Awarding matching grants to selected eligible grant recipients; and 6 (k) Compiling for the annual report submitted under KRS 147A.164 the 7 following information about the project: 8 1. A list of all program applicants; 9 2. The identity of applicants who were not selected for recommendation; 10 3. Trends found in feedback given to applicants who were not selected for 11 recommendation; 12 4. Eligible uses of the projects cited in the grant applications; and 13 5. Any other information requested by the department. 14 (2) The department shall determine the terms, conditions, and requirements of 15 application for grant funds awarded from the Government Resources Accelerating 16 Needed Transformation Program fund. The department may establish procedures 17 and standards for the review and approval of eligible grant awards through the 18 promulgation of administrative regulations in accordance with KRS Chapter 13A. 19 (3) The commissioner of the department shall have the authority to hire staff, contract 20 for services, expend funds, and operate the normal business activities of the 21 Government Resources Accelerating Needed Transformation Program. 22 (4) The Government Resources Accelerating Needed Transformation Program shall 23 sunset on April 15, 2025. The department shall not accept any application or 24 obligate any funds under Section 10 of this Act on or after April 15, 25 2024[December 31, 2026, unless authorized by the General Assembly to continue 26 its work for a specified period of time]. 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 17 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA (5) The Kentucky Council of Area Development Districts and local area development 1 districts shall assist priority communities in identifying available grant 2 opportunities and preparing Government Resources Accelerating Needed 3 Transformation Program applications. Nothing in this subsection prevents any 4 public agency or nonprofit entity from assisting priority communities in identifying 5 and preparing Government Resources Accelerating Needed Transformation 6 Program applications. 7 Section 10. KRS 147A.158 is amended to read as follows: 8 (1) There is hereby established in the State Treasury a trust and agency account to be 9 known as the Government Resources Accelerating Needed Transformation Program 10 fund. The fund shall consist of moneys received from state appropriations, gifts, 11 grants, and federal funds. 12 (2) The fund shall be administered and maintained by the department. 13 (3) Amounts deposited in the fund shall be used for: 14 (a) Awarding matching fund grants to applicants of the Government Resources 15 Accelerating Needed Transformation Program upon notification of award of 16 the federal grant requiring matching funds; and 17 (b) Administration of the program. 18 (4) Notwithstanding KRS 45.229, moneys in the account not expended at the close of a 19 fiscal year shall not lapse but shall be carried forward into the next fiscal year. 20 (5) Any interest earnings of the fund shall become a part of the fund and shall not 21 lapse. 22 (6) Moneys deposited in the fund are hereby appropriated for the purposes set forth in 23 this section and shall not be appropriated or transferred by the General Assembly 24 for any other purposes. 25 (7) Any amounts obligated under subsection (3)(a) of this section shall be canceled 26 upon denial of the federal award. 27 UNOFFICIAL COPY 24 RS HB 723/GA Page 18 of 63 HB072310.100 - 804 - XXXX 3/15/2024 9:43 AM GA (8) By December 1, 2023, and annually thereafter until December 1, 2024[December 1, 1 2026], the department shall prepare an annual report detailing the expenditures for 2 the administration of the program from the fund, which shall be included in the 3 annual report submitted under KRS 147A.164. 4 (9) Any moneys in the fund on or after June 30, 2024, shall be transferred to the 5 Government Resources Accelerating Needed Transformation Program of 2024 6 fund administered by the Department of Agriculture created in Section 6 of this 7 Act. 8 Section 11.
