AN ACT relating to mental health programs. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
Section 1.   KRS 210.450 is amended to read as follows: 3 
In addition to the powers and duties already conferred upon him or her by the law, the 4 
secretary of the Cabinet for Health and Family Services shall: 5 
(1) Promulgate policies and regulations governing eligibility of community programs 6 
for mental health or individuals with an intellectual disability to receive state grants 7 
and other fund allocations from the Cabinet for Health and Family Services, 8 
prescribing standards for qualification of personnel and quality of professional 9 
service and for in-service training and educational leave programs for personnel, 10 
governing eligibility for service so that no person will be denied service on the basis 11 
of race, color or creed, or inability to pay, providing for establishment of fee 12 
schedules which shall be based upon ability to pay, regulating fees for diagnostic 13 
services, which services may be provided for anyone without regard to his or her 14 
financial status, when referred by the courts, schools, or health and welfare agencies 15 
whether public or private, governing financial record keeping, prescribing standards 16 
for personnel management operations, providing for financial and program 17 
reporting requirements, and such other policies and regulations as he or she deems 18 
necessary to carry out the purposes of KRS 210.370 to 210.460; 19 
(2) Review and evaluate local programs and the performance of administrative and 20 
psychiatric personnel and make recommendations thereon to community boards for 21 
mental health or individuals with an intellectual disability and program 22 
administrators; 23 
(3) Provide consultative service, by professionals qualified in the areas of mental health 24 
and intellectual disabilities by education and training, to communities to assist in 25 
ascertaining local needs and in planning and establishing community programs for 26

(4) Employ necessary and qualified personnel to implement KRS 210.370 to 210.460; 1 
and 2 
(5) Review annually the personnel policies, procedures, and personnel compensation 3 
plans of community boards for mental health or individuals with an intellectual 4 
disability and disapprove if not consistent with accepted standards of personnel and 5 
salary administration prescribed by the cabinet. 6
