UNOFFICIAL COPY 24 RS BR 33 Page 1 of 1 XXXX 8/15/2023 12:35 PM Jacketed AN ACT relating to orders of protection. 1 Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 532 IS CREATED TO 3 READ AS FOLLOWS: 4 (1) As used in this section, "qualifying offense" means a felony offense under: 5 (a) KRS Chapter 507, 508, 510, 515, or 531; 6 (b) KRS 509.020, 509.030, 509.040, or 509.080; 7 (c) KRS 511.020, 511.030, or 511.040; 8 (d) KRS 513.020, 513.030, or 513.040; 9 (e) KRS 524.055; 10 (f) KRS 530.020, 530.064, or 530.065; or 11 (g) Criminal attempt, conspiracy, facilitation, or solicitation to commit any of 12 the offenses listed under paragraphs (a) to (f) of this subsection. 13 (2) The entry of a judgment of conviction for a qualifying offense shall operate as an 14 application for an order of protection issued under KRS Chapter 456, unless the 15 victim requests otherwise. 16 (3) Notwithstanding the provisions of KRS Chapter 456: 17 (a) An order of protection requested under this section may be issued by the 18 court that entered the judgment of conviction; 19 (b) The judgment of conviction shall constitute sufficient cause for the entry of 20 the order of protection without the necessity of further proof being taken; 21 and 22 (c) The order of protection may be effective for the lifetime of the victim or 23 defendant. 24 (4) Any person who intentionally violates the provisions of an order of protection 25 issued under this section shall be subject to KRS 456.180. 26
