AN ACT relating to court proceedings. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘Section 1. KRS 24A.320 is amended to read as follows: 3
(1) All claims in the small claims division shall be tried without a jury. Upon filing a 4
claim, the plaintiff shall be deemed to have waived his or her right to a jury trial in 5
the division. This waiver shall be explained on the claim form provided by the 6
clerk. 7
(2) If the defendant in any action desires a jury trial, he or she shall give written notice 8
to the division at least seven (7) days prior to the time set for the hearing, and the 9
case shall be removed to the regular docket of the District Court, and shall 10
thereafter be subject to all the provisions of law and rules of court applicable to 11
proceedings in the District Court. 12
