AN ACT relating to transportation network companies. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 281 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) A transportation network company (TNC) shall not be liable by reason of owning, 5
operating, or maintaining the digital network or mobile application accessed by a 6
transportation network company driver, or by reason of being the TNC affiliated 7
with a TNC driver, for harm to persons or property which results or arises out of 8
the use, operation, or possession of a motor vehicle while a TNC driver is logged 9
on to the TNC's digital network or mobile application unless: 10
(a) There is direct negligence by the TNC; or 11
(b) The TNC has the contractual right to control the manner and means of the 12
work. 13
(2) For all purposes including but not limited to common law tort, a TNC or TNC 14
driver is not a common carrier. 15
