AN ACT relating to guardian ad litem fees. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
SECTION 1. A NEW SECTION OF KRS CHAPTER 403 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) Except as provided in subsection (2) of this section, in any court proceeding 5
conducted pursuant to this chapter, a guardian ad litem appointed for a minor 6
child shall be paid a reasonable fee to be fixed by the court and paid by the 7
Finance and Administration Cabinet, provided that: 8
(a) The parties have an active order of protection; and 9
(b) Both parents are indigent as defined in KRS 31.100. 10
(2) In any court proceeding conducted pursuant to KRS 403.715 to 403.785, a 11
guardian ad litem appointed for a minor child shall be paid a reasonable fee to be 12
fixed by the court and paid by the Finance and Administration Cabinet. 13
SECTION 2. A NEW SECTION OF KRS CHAPTER 456 IS CREATED TO 14
READ AS FOLLOWS: 15
In any court proceeding conducted pursuant to this chapter, a guardian ad litem 16
appointed for a minor child shall be paid a reasonable fee to be fixed by the court and 17
paid by the Finance and Administration Cabinet. 18
