A NEW SECTION OF KRS 186.400 TO 186.640 IS CREATED 3 TO READ AS FOLLOWS: 4 (1) The Transportation Cabinet shall establish at least one (1) permanent, full-time, 5 driver licensing regional office within each Kentucky senatorial district. 6 (2) For the purposes of this section, an office shall be considered to be within a 7 senatorial district if it is located anywhere in a county which is part of the district, 8 whether or not the office is located within the actual boundaries of the district. 9 SECTION 2. A NEW SECTION OF KRS 186.400 TO 186.640 IS CREATED 10 TO READ AS FOLLOWS: 11 (1) As used in this section, "identity document": 12 (a) Means an operator's license or personal identification card issued to a 13 United States citizen or permanent resident under KRS 186.412 or 14 186.4122; and 15 (b) Does not include: 16 1. An operator's license or personal identification card issued to an 17 individual who is not a United States citizen or permanent resident 18 under KRS 186.4121 or 186.4123; 19 2. An instruction permit issued under KRS 186.450; or 20 3. A commercial driver's license issued under KRS Chapter 281A. 21 (2) Beginning July 1, 2025, in any county in which the cabinet has not established a 22 permanent, full-time, driver licensing regional office, the county clerk of that 23 county may act as an application processor for identity documents. 24 (3) The cabinet shall: 25 (a) Identify those county clerks described in subsection (2) of this section who 26 wish to act as an application processor for identity documents; 27 UNOFFICIAL COPY 24 RS SB 91/GA Page 2 of 8 SB009110.100 - 805 - XXXX 2/20/2024 5:12 PM GA (b) Enter into agreements with those county clerks who wish to act as an 1 application processor for identity documents; 2 (c) Promulgate administrative regulations in accordance with KRS Chapter 3 13A to establish procedures for county clerks to act as an application 4 processor for identity documents; and 5 (d) Pay the cost of any hardware and software required by the county clerks to 6 facilitate the application process. 7 (4) A county clerk acting as an application processor for identity documents under 8 this section shall: 9 (a) Enter into an agreement with the cabinet; 10 (b) Comply with all relevant administrative regulations and policies of the 11 cabinet; and 12 (c) Collect all required fees under Section 3 of this Act and transmit the 13 required amount to the cabinet in a timely fashion. 14 Section 3. KRS 186.531 is amended to read as follows: 15 (1) As used in this section: 16 (a) "GF" means the general fund; 17 (b) "IP" means instruction permit; 18 (c) "License Fund" or "LF" means the KYTC photo license account created in 19 KRS 174.056; 20 (d) "MC" means motorcycle; 21 (e) "MC Fund" or "MCF" means the motorcycle safety education program fund 22 established in KRS 176.5065; 23 (f) "OL" means operator's license; and 24 (g) "PIDC" means personal identification card. 25 (2) The fees imposed for voluntary travel ID operator's licenses, instruction permits, 26 and personal identification cards shall be as follows. Except as provided in subsection (11) of this section, the fees received 17 shall be distributed as shown in the table. The distribution of fees shown in subsections (2) and (3) of this 10 section shall also be reduced by fifty percent (50%) for licenses that are issued for 11 four (4) years. 12 (5) Any fee for any identity document applied for using alternative technology under 13 KRS 186.410 and 186.4122 shall be distributed in the same manner as a document 14 applied for in person with the cabinet. 15 (6) (a) An applicant for an original or renewal operator's license, permit, commercial 16 driver's license, motorcycle operator's license, or personal identification card 17 shall be requested by the cabinet to make a donation to promote an organ 18 donor program. 19 (b) The donation under this subsection shall be added to the regular fee for an 20 original or renewal motor vehicle operator's license, permit, commercial 21 driver's license, motorcycle operator's license, or personal identification card. 22 One (1) donation may be made per issuance or renewal of a license or any 23 combination thereof. 24 (c) The fee shall be paid to the cabinet and shall be forwarded by the cabinet on a 25 monthly basis to the Kentucky Circuit Court Clerks' Trust for Life, and such 26 moneys are hereby appropriated to be used exclusively for the purpose of 27 UNOFFICIAL COPY 24 RS SB 91/GA Page 5 of 8 SB009110.100 - 805 - XXXX 2/20/2024 5:12 PM GA promoting an organ donor program. A donation under this subsection shall be 1 voluntary and may be refused by the applicant at the time of issuance or 2 renewal. 3 (7) In addition to the fees outlined in this section, the following individuals, upon 4 application for an initial or renewal operator's license, instruction permit, or 5 personal identification card, shall pay an additional application fee of thirty dollars 6 ($30), which shall be deposited in the photo license account: 7 (a) An applicant who is not a United States citizen or permanent resident and who 8 applies under KRS 186.4121 or 186.4123; or 9 (b) An applicant who is applying for a instruction permit, operator's license, or 10 personal identification card without a photo under KRS 186.4102(9). 11 (8) (a) Except for individuals exempted under paragraph (c) of this subsection, an 12 applicant for relicensing after revocation or suspension shall pay a 13 reinstatement fee of forty dollars ($40). 14 (b) The reinstatement fee under this subsection shall be distributed by the State 15 Treasurer as follows: 16 1. Thirty-five dollars ($35) shall be deposited into the photo license 17 account; and 18 2. Five dollars ($5) shall be deposited into a trust and agency fund to be 19 used in defraying the costs and expenses of administering a driver 20 improvement program for problem drivers. 21 (c) This subsection shall not apply to: 22 1. Any person whose license was suspended for failure to meet the 23 conditions set out in KRS 186.411 when, within one (1) year of 24 suspension, the driving privileges of the individual are reinstated; or 25 2. A student who has had his or her license revoked pursuant to KRS 26 159.051. 27 UNOFFICIAL COPY 24 RS SB 91/GA Page 6 of 8 SB009110.100 - 805 - XXXX 2/20/2024 5:12 PM GA (9) As payment for any fee identified in this section, the cabinet: 1 (a) Shall accept cash and personal checks; 2 (b) May accept other methods of payment in accordance with KRS 45.345; and 3 (c) May enter into billing agreements with homeless shelters, health care 4 facilities, or social service agencies that serve individuals without an 5 established and fixed nighttime residence of regular return. 6 (10) There shall be no fee assessed for the initial, renewal, or duplicate standard personal 7 identification card to an individual, if the individual: 8 (a) Does not possess a valid operator's license or a commercial driver's license; 9 and 10 (b) Is at least eighteen (18) years of age on or before the next regular election. 11 (11) If the application for an operator's license or personal identification card is 12 processed by a county clerk under Section 2 of this Act, the county clerk that 13 processes the application shall retain twenty-five percent (25%) of the amount of 14 the fee that is directed to the license fund under subsections (2) and (3) of this 15 section. 16 SECTION 4. A NEW SECTION OF KRS 186.400 TO 186.640 IS CREATED 17 TO READ AS FOLLOWS: 18 (1) As used in this section: 19 (a) "Identity document": 20 1. Means an operator's license or personal identification card issued to a 21 United States citizen or permanent resident under KRS 186.412 or 22 186.4122; and 23 2. Does not include: 24 a. An operator's license or personal identification card issued to an 25 individual who is not a United States citizen or permanent 26 resident under KRS 186.4121 or 186.4123; 27 UNOFFICIAL COPY 24 RS SB 91/GA Page 7 of 8 SB009110.100 - 805 - XXXX 2/20/2024 5:12 PM GA b. An instruction permit issued under KRS 186.450; or 1 c. A commercial driver's license issued under KRS Chapter 281A; and 2 (b) "Third-party entity" means a business or nonprofit member association. 3 (2) The Transportation Cabinet shall promulgate administrative regulations in 4 accordance with KRS Chapter 13A to establish procedures by which third-party 5 entities may apply to the cabinet to serve as an application processor for identity 6 documents. 7 (3) A third-party entity that wishes to serve as an application processor for identity 8 documents under this section shall: 9 (a) Apply to the cabinet and receive cabinet approval; 10 (b) Agree to comply with all relevant administrative regulations and policies of 11 the cabinet; 12 (c) Pay the cost of any hardware required to facilitate the application process; 13 and 14 (d) Collect all required fees under Section 3 of this Act and transmit them to the 15 cabinet in a timely fashion. 16 (4) In addition to the fees set forth in Section 3 of this Act, a third-party entity that 17 processes applications for identity documents under this section may charge a fee 18 for the service provided. 19 SECTION 5. A NEW SECTION OF KRS 186.400 TO 186.640 IS CREATED 20 TO READ AS FOLLOWS: 21 (1) As used in this section, "state police" means the Department of Kentucky State 22 Police. 23 (2) From September 1, 2024, until June 30, 2026, the state police shall operate a pilot 24 program to provide operator's license skills testing in five (5) counties in which 25 the state police does not provide permanent, full-time, driver licensing testing. 26 (3) In administering the pilot project under this section, the state police shall: 27 UNOFFICIAL COPY 24 RS SB 91/GA Page 8 of 8 SB009110.100 - 805 - XXXX 2/20/2024 5:12 PM GA (a) Identify the counties participating in the pilot project based on both public 1 demand and available state police resources; 2 (b) Provide testing in each county at least two (2) times each month; 3 (c) Accept applications for testing slots through the state police's online 4 application portal; 5 (d) Limit testing only to residents of the pilot project county where the test will 6 be administered; 7 (e) Limit testing only to applicants for an intermediate license under KRS 8 186.452; and 9 (f) Evaluate service levels, unsubscribed appointments, and no-shows during 10 the term of the pilot project and, if necessary, move the pilot project to 11 another county identified in subsection (2) of this section, while 12 maintaining the pilot project in at least five (5) counties during the term of 13 the project. 14 (3) The state police shall collect data on testing done under this section and, by 15 October 31, 2025, submit a report to the Legislative Research Commission for 16 referral to the Interim Joint Committee on Transportation providing: 17 (a) Counts of the number of available testing appointments in each county, 18 applicants served, unclaimed testing slots, and no-show appointments; 19 (b) Information regarding how the pilot program affected testing associated 20 with regional licensing offices; and 21 (c) Recommendations on the continuation or expansion of the pilot project. 22 Section 6. Section 1 of this Act takes effect July 1, 2025. 23
