UNOFFICIAL COPY 24 RS BR 1198 Page 1 of 2 XXXX 3/12/2024 1:35 PM Jacketed A RESOLUTION opposing the United States' participation in the World Health 1 Organization Pandemic Agreement. 2 WHEREAS, the World Health Organization's negotiated the draft Pandemic 3 Agreement in November 2023, and is set to adopt the final agreement by May 2024, it is 4 set to pass the final treaty; and 5 WHEREAS, on the basis of the text of the draft Pandemic Agreement, the United 6 States and other countries that ratify it would need to commit to temporarily waive 7 intellectual property rights; and 8 WHEREAS, Article I, Section 8 of the Constitution of the United States clearly 9 states that Congress shall have power "to promote the Progress of Science and useful 10 Arts, by securing for limited Times to authors and inventors the exclusive Right to their 11 respective Writing and Discoveries" which ensures copyright holders rights to their 12 intellectual property; and 13 WHEREAS, Section 1 of the Constitution of Kentucky states that among the certain 14 and inalienable rights of men is the right of acquiring and protecting property; and 15 WHEREAS, ratification of the World Health Organization's Pandemic Agreement 16 would also encroach on the sovereignty of the United States at the expense of our laws, 17 the Constitution of Kentucky, and the Constitution of the United States; and 18 WHEREAS, the rights of our citizens granted by the Constitution will not be 19 delegated to nor imposed by any unelected foreign agency; and 20 WHEREAS, it is the intent of this honorable body to defend the Commonwealth of 21 Kentucky against violations of the Constitution of the United States and further prevent 22 subjecting the sovereignty and rights of the United States of America to any foreign 23 nation or collective; 24 NOW, THEREFORE, 25 Be it resolved by the Senate of the General Assembly of the Commonwealth of 26 Kentucky: 27 UNOFFICIAL COPY 24 RS BR 1198 Page 2 of 2 XXXX 3/12/2024 1:35 PM Jacketed ď˘Section 1. The Senate of the Commonwealth of Kentucky opposes the United 1 States' participation in the World Health Organization's Pandemic Agreement, and if 2 signed by the President of the United States and ratified by the United States' Senate, 3 opposes the appropriation of any federal or state funds to implement it. 4
