AN ACT relating to corrections data reporting. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
Section 1.   KRS 439.3103 is amended to read as follows: 3 
(1) By December 1 of each year[, beginning in 2012,] the department shall submit to 4 
the Governor, the Legislative Research Commission for referral to the Interim 5 
Joint Committee on Judiciary[General Assembly], and the Chief Justice a 6 
comprehensive report on its efforts to implement evidence-based practices to reduce 7 
recidivism. The report shall include at a minimum: 8 
(a) The percentage of supervised individuals being supervised in accordance with 9 
evidence-based practices; 10 
(b) The percentage of state moneys expended by the department for programs that 11 
are evidence based, and a list of all programs with identification of which are 12 
evidence based; 13 
(c) Specification of supervision policies, procedures, programs, and practices that 14 
were created, modified, or eliminated;[ and] 15 
(d) The department's recommendations for resource allocation, and any additional 16 
collaboration with other state, regional, or local public agencies, private 17 
entities, or faith-based and community organizations; 18 
(e) A length of stay report on time served by first time offenders released from 19 
an institution, which shall include for each offense the: 20 
1. Number of persons released; 21 
2. Average sentence; 22 
3. Average time served in years; 23 
4. Average percentage of the sentence served; 24 
5. Percentage of persons released on parole; and 25 
6. Number of persons released who were serving a life sentence or a life 26 
sentence without benefit of probation or parole until he or she has 27  UNOFFICIAL COPY  	25 RS HB 136/GA

served a minimum of twenty-five (25) years of his or her sentence, and 1 
the average time served in years; and 2 
(f) A report on persons released from an institution on parole that shall include 3 
the following: 4 
1. Demographic information, including but not limited to: 5 
a. Gender; 6 
b. Race; 7 
c. Age group at the time of release; 8 
d. Parental status, and if the person is a parent, whether he or she 9 
has any form of custody of his or her children; and 10 
e. Gang affiliation; 11 
2. Prison case information, including but not limited to: 12 
a. Education level upon entry; 13 
b. The number of dependents upon entry; 14 
c. The crime of conviction; and 15 
d. The number of years in prison prior to release; 16 
3. Prior community supervision history, including any prior probation or 17 
parole revocations; 18 
4. Conditions of supervision, including but not limited to: 19 
a. Mental health or substance abuse programming; 20 
b. Cognitive skills or education programming; and 21 
c. Any other condition of supervision; 22 
5. Supervision activities, including but not limited to: 23 
a. Parole violations; 24 
b. The average number of days on parole between drug tests and 25 
the percentage of positive drug tests; 26

d. The number of jobs per year while on parole and the percentage 1 
of days employed while on parole; and 2 
e. The number of residence changes to a new zip code during 3 
parole; 4 
6. Prior criminal history, including the number of prior arrests and 5 
convictions; and 6 
7. Rates of recidivism. 7 
(2) The department shall: 8 
(a) Collect all data necessary to prepare the report and may promulgate 9 
administrative regulations in accordance with KRS Chapter 13A to 10 
implement this section; and 11 
(b) Make the full report and an executive summary available to the general public 12 
on its website[Web site]. 13 
Section 2.   This Act takes effect January 1, 2026. 14
