AN ACT relating to corrections. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
Section 1.   KRS 439.3103 is amended to read as follows: 3 
(1) By December 1 of each year[, beginning in 2012,] the department shall submit to 4 
the Governor, the Legislative Research Commission for referral to the Interim 5 
Joint Committee on Judiciary[General Assembly], and the Chief Justice a 6 
comprehensive report on its efforts to implement evidence-based practices to reduce 7 
recidivism. The report shall include at a minimum: 8 
(a) The percentage of supervised individuals being supervised in accordance with 9 
evidence-based practices; 10 
(b) The percentage of state moneys expended by the department for programs that 11 
are evidence based, and a list of all programs with identification of which are 12 
evidence based; 13 
(c) Specification of supervision policies, procedures, programs, and practices that 14 
were created, modified, or eliminated;[ and] 15 
(d) The department's recommendations for resource allocation, and any additional 16 
collaboration with other state, regional, or local public agencies, private 17 
entities, or faith-based and community organizations; 18 
(e) A length of stay report on time served by first time incarcerated individuals 19 
released from the department's custody, which shall include for each 20 
offense the: 21 
1. Number of persons released; 22 
2. Average sentence in days; 23 
3. Average time served in days; 24 
4. Average percentage of the sentence served; 25 
5. Percentage of persons released on supervision; and 26 
6. Number of persons released who were serving a life sentence or a life 27  UNOFFICIAL COPY  	25 RS HB 136/VO

sentence without benefit of probation or parole until he or she has 1 
served a minimum of twenty-five (25) years of his or her sentence, and 2 
the average time served in days; and 3 
(f) A report on persons released from the department's custody on supervision 4 
that shall include the following: 5 
1. Demographic information, including but not limited to: 6 
a. Gender; 7 
b. Race; 8 
c. Age group at the time of release; 9 
d. Parental status, and if the person is a parent, whether he or she 10 
has any form of custody of his or her children; and 11 
e. Gang affiliation; 12 
2. Case information, including but not limited to: 13 
a. Education level upon release; 14 
b. The number of dependents upon release; 15 
c. The crime of conviction; 16 
d. Whether the person was sentenced on or after July 15, 2024; and 17 
e. The number of days in custody prior to release; 18 
3. Count of: 19 
a. Prior community supervision periods; and 20 
b. Community supervision revocations; 21 
4. Conditions of supervision, including but not limited to: 22 
a. Mental health or substance abuse programming; 23 
b. Cognitive skills or education programming; and 24 
c. Any other condition of supervision; 25 
5. Supervision activities, including but not limited to: 26

b. The number of nontechnical violations; 1 
c. The number of drug tests; 2 
d. The percentage or number of positive drug tests; 3 
e. The number of program completions while on supervision for 4 
which the offender received good time credits and attendance 5 
has been verified; 6 
f. The number of jobs per year while on parole and the percentage 7 
of days employed while on parole; and 8 
g. The number of residence changes to a new zip code during 9 
parole; 10 
6. Prior criminal history, including the number of prior arrests and 11 
convictions; and 12 
7. Rates of recidivism. 13 
(2) The department shall: 14 
(a) Collect all data necessary to prepare the report and may promulgate 15 
administrative regulations in accordance with KRS Chapter 13A to 16 
implement this section; and 17 
(b) Make the full report and an executive summary available to the general public 18 
on its website[Web site]. 19 
Section 2. Notwithstanding any provision of law to the contrary, the 20 
Department of Corrections shall procure a new inmate communications contract by 21 
January 1, 2026. 22 
Section 3.   Section 1 of this Act takes effect January 1, 2026. 23
