AN ACT relating to smash and grab burglary. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 511 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) A person is guilty of smash and grab burglary when, with the intent to commit a 5
theft, he or she intentionally enters a retail establishment and causes damage in 6
excess of five hundred dollars ($500) to the establishment without the owner's 7
consent. 8
(2) Smash and grab burglary is a Class B felony, unless the person uses a motor 9
vehicle to cause damage to the retail establishment, in which case it is a Class A 10
felony. 11
