AN ACT relating to the practice of pharmacy. 1
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2
ď˘SECTION 1. A NEW SECTION OF KRS CHAPTER 315 IS CREATED TO 3
READ AS FOLLOWS: 4
(1) Notwithstanding any other provision of law to the contrary, when a pharmacist is 5
aware that a practitioner has died, a prescription issued by that practitioner may 6
continue to be dispensed based on the pharmacist's professional judgment and in 7
accordance with the following requirements: 8
(a) A new prescription that has not been previously dispensed may be dispensed 9
no later than ninety (90) days following the date on which the practitioner 10
died; and 11
(b) A prescription that has been previously dispensed and has valid 12
authorization to be refilled may be dispensed no later than one hundred 13
eighty (180) days following the date on which the practitioner died. 14
(2) Nothing in this section authorizes the dispensing of a prescription that was issued 15
for a controlled substance unless permitted under the federal Controlled 16
Substances Act and regulations of the United States Drug Enforcement 17
Administration. 18
