A NEW SECTION OF KRS CHAPTER 12 IS CREATED TO 4 READ AS FOLLOWS: 5 (1) The Office of Safer Communities is hereby established as an independent agency 6 attached to the Office of the Governor, which shall be headed by an executive 7 director appointed by the Governor. The purpose of the office is to develop 8 strategies to coordinate and promote effective ways to reduce community violence 9 through collaborations with local, state, and federal government agencies. 10 (2) As used in this section: 11 (a) "Community violence" means all deaths or injuries caused by a firearm; 12 (b) "Local educational agency" has the same meaning as in 20 U.S.C. sec. 13 7801(30); 14 (c) "Office" means the Office of Safer Communities; and 15 (d) "State educational agency" has the same meaning as in 20 U.S.C. sec. 16 7801(49). 17 (3) The office shall: 18 (a) Obtain alternative funding sources other than the Commonwealth, 19 including gifts, grants, and bequests; 20 (b) Promote or assist in establishing or enhancing community violence 21 intervention and school-based mental health programs; 22 (c) Coordinate with existing community violence intervention and school-based 23 mental health programs to minimize duplication of services; 24 (d) Collect and disseminate data and make recommendations relating to 25 community violence, policy and intervention programs and school-based 26 mental health programs, from both a public safety and a public health 27 UNOFFICIAL COPY 25 RS BR 1460 Page 2 of 33 XXXX 2/4/2025 5:28 PM Jacketed perspective; 1 (e) Create and implement a plan for collection, assessment, and analysis of 2 relevant data, including the: 3 1. Geographic locations of community violence; 4 2. Nature of community violence, including: 5 a. Domestic violence; 6 b. Suicide; 7 c. Child abuse; 8 d. Accidental shootings; and 9 e. Mass shootings; 10 3. Frequency of incidents of community violence; 11 4. Number of victims of community violence; and 12 5. Impacts of gun violence by demographic group; 13 (f) Perform other duties relevant to policy development and implementation to 14 support communities impacted by community violence; 15 (g) Collect and disseminate data and make recommendations relating to school-16 based mental health services in high-need local educational agencies and 17 state educational agencies, including the: 18 1. Impact of the lack of mental health service providers on students; 19 2. Ratio of school-based mental health providers to students; 20 3. Retention rate of school-based mental health service providers; and 21 4. Recruitment processes in place for school-based mental health service 22 providers; and 23 (h) Report to the Governor and employ such staff as necessary to perform the 24 duties, functions, and responsibilities of the office; 25 (4) By February 1 of each year, each law enforcement agency and coroner shall 26 report all statistical data involving community violence for the previous calendar 27 UNOFFICIAL COPY 25 RS BR 1460 Page 3 of 33 XXXX 2/4/2025 5:28 PM Jacketed year to the office. 1 (5) By November 1 of each year, the office shall review, approve, and coordinate all 2 proposed and current community violence intervention programs and projects 3 and school-based mental health programs and projects that are: 4 (a) Conducted by or receive funding through agencies of the executive branch; 5 and 6 (b) Principally related to the prevention or the reduction of community violence 7 in the Commonwealth. 8 (6) By November 1 of each year, the office shall submit an annual report outlining 9 the data collected and the office's recommendations regarding community 10 violence and school-based mental health services and intervention to the 11 Legislative Research Commission for referral to the Interim Joint Committees on 12 Health Services and Families and Children. 13 (7) The office shall promulgate administrative regulations in accordance with KRS 14 Chapter 13A to implement this section. 15 Section 2. KRS 12.020 (Effective until July 1, 2025) is amended to read as 16 follows: 17 Departments, program cabinets and their departments, and the respective major 18 administrative bodies that they include are enumerated in this section. It is not intended 19 that this enumeration of administrative bodies be all-inclusive. There is hereby appropriated General Fund moneys in the amount of 6 $3,000,000 in fiscal year 2025-2026 from the Budget Reserve Trust Fund Account 7 established by KRS 48.705 to the Office of Safer Communities for the purposes outlined 8 in Section 1 of this Act. Notwithstanding KRS 45.229, the General Fund appropriation 9 shall not lapse and shall carry forward in the Office of Safer Communities. 10 Section 6. Whereas community violence is a pervasive and growing problem 11 nationwide and an emerging crisis with the state of Kentucky, and a delay in the 12 implementation of this Act would severely hinder the safety of the citizens of Kentucky, 13 an emergency is declared to exist, and this Act takes effect upon its passage and approval 14 by the Governor or upon its becoming a law. 15
