AN ACT relating to responsible gambling. 1 
Be it enacted by the General Assembly of the Commonwealth of Kentucky: 2 
SECTION 1.   A NEW SECTION OF KRS CHAPTER 230 IS CREATED TO 3 
READ AS FOLLOWS: 4 
(1) Any track licensed by the corporation to conduct live horse racing or races 5 
previously run shall implement a program to promote responsible gambling by its 6 
patrons and provide details of the same to the corporation. At a minimum, the 7 
program shall require: 8 
(a) Posting in a conspicuous location, in every place where pari-mutuel 9 
wagering on historical horse racing is conducted, a sign that bears a toll-10 
free telephone number approved by the Kentucky Council on Problem 11 
Gambling or other organization that provides assistance to problem 12 
gamblers; 13 
(b) Providing informational leaflets or other similar materials on its licensed 14 
premises on the dangers associated with problem gambling; 15 
(c) Including in the licensee's promotional and marketing materials 16 
information on problem gambling and organizations that provide assistance 17 
to problem gamblers; 18 
(d) Routine auditing of patron activity to identify patrons who have suffered 19 
significant financial losses in repeated visits to its licensed premises and 20 
providing such patrons with information on organizations that provide 21 
assistance to problem gamblers; 22 
(e) Training for employees at licensed tracks that also hold a license issued 23 
under KRS 243.265 to identify patrons who have consumed excessive 24 
amounts of alcohol to prevent such patrons from continuing to engage in 25 
wagering activity while impaired; 26 
(f) Forming a partnership with the Kentucky Council on Problem Gambling, 27  UNOFFICIAL COPY  	25 RS BR 1859

the National Council on Problem Gambling, or other similar organization 1 
to identify and promote best practices for preventing problem gambling; and 2 
(g) Training for all employees who have contact with patrons, as well as 3 
administrative and corporate staff members, that shall include skills and 4 
procedures to respond to situations where a patron exhibits warning signs 5 
of a gambling problem or where a patron discloses he or she may have a 6 
gambling problem. Employees and staff shall be trained immediately upon 7 
their hiring and retrained and tested regularly. 8 
(2) A licensee shall report annually to the corporation, and make a copy available to 9 
the public, on its efforts to meet the requirements of subsection (1) of this section, 10 
including its efforts to identify problem gamblers and steps taken to: 11 
(a) Prevent such individuals from continuing to engage in pari-mutuel 12 
wagering on historical horse racing; and 13 
(b)_ Provide assistance to these individuals to address problem gambling activity. 14
