BY REPRESENTATIVE HENRY
MTR VEHICLE/TOWING: Prohibits towing and storage companies from charging gate
fees
AN ACT1
To enact R.S. 32:1734(E), relative to gate fees; to prohibit towing or storage companies2
from charging gate fees when operating outside of normal business hours; and to3
provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 32:17.4(E) is hereby enacted to read as follows: 6
ยง1734.  Gate fees; other fees; excessive charges; prohibitions; cause of action7

E. Any towing or storage company that staffs its facility outside of normal9
business hours to conduct business, including but not limited to receiving or10
releasing vehicles or filing an Official Report of Stored Vehicle (ORSV), shall not11
charge a gate fee.12

Abstract:  Prohibits towing or storage companies from charging gate fees when operating

Present law defines a "gate fee" as the charge assessed by a towing or storage company for

Proposed law prohibits a towing or storage company that staffs its facility outside of normal
business hours to conduct business, including but not limited to receiving or releasing
vehicles or filing an Official Report of Stored Vehicle (ORSV), from charging a gate fee.
