Regular Session, 2010 HOUSE BILL NO. 1043 BY REPRESENTATIVE HENRY MTR VEHICLE/TOWING: Prohibits towing and storage companies from charging gate fees AN ACT1 To enact R.S. 32:1734(E), relative to gate fees; to prohibit towing or storage companies2 from charging gate fees when a vehicle is towed outside of normal business hours;3 and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 32:1734(E) is hereby enacted to read as follows: 6 ยง1734. Gate fees; other fees; excessive charges; prohibitions; cause of action7 * * *8 E. Present law defines a "gate fee" as the charge assessed by a towing or storage company for releasing a towed vehicle before or after business hours. Proposed law prohibits a towing or storage company from charging a gate fee during the first 24 hours of storage on a vehicle that is towed outside the normal business hours of 8:00 a.m. to 5:00 p.m., Monday through Friday, when the tow is made from private property in accordance with proposed law.
