WORKERS COMPENSATI ON:  Provides relative to confidentiality of tax records
AN ACT1
To enact R.S. 47:1508(B)(28), relative to the confidentiality of tax records; to provide for2
the furnishing of tax record information to the Louisiana Workforce Commission for3
the purpose of determining, investigating, and prosecuting fraud; to provide for the4
confidentiality of such information; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 47:1508(B)(28) is hereby enacted to read as follows:7
ยง1508.  Confidential character of tax records8

B.  Nothing herein contained shall be construed to prevent:10

(28) The sharing or furnishing, in the discretion of the secretary, of12
information to the Louisiana Workforce Commission for the purposes of13
determining, investigating, or prosecuting fraud related to all areas administered by14
the Louisiana Workforce Commission. Any information shared or furnished shall15
be considered and held confidential and privileged by the Louisiana Workforce16
Commission to the same extent heretofore provided.17

Abstract: Provides for furnishing of tax record information to the La. Workforce
Commission for the purposes of determining, investigating, and prosecuting fraud.
Present law provides records and files of the secretary of the Department of Revenue (DOR)
and records and files maintained pursuant to a tax ordinance, excluding property taxes and
ad valorem property tax assessment rolls of any political subdivision are confidential.
Proposed law provides that at the secretary of the DOR's discretion, nothing shall prevent
the sharing or furnishing of tax record information to the La. Workforce Commission for the
purposes of determining, investigating, or prosecuting fraud.  Further requires any
information shared or furnished by the DOR be held confidential and privileged by the La.
Workforce Commission.
