FUNDS/FUNDING: Provides for the Department of Justice Legal Support Fund
AN ACT1
To amend and reenact R.S. 49:259(B), relative to the Department of Justice Legal Support2
Fund, to increase the maximum allowable fund balance; to provide for an effective3
date; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 49:259(B) is hereby amended and reenacted to read as follows: 6

B. After satisfying the requirements of the Bond Security and Redemption9
Fund as provided in Article VII, Section 9(B) of the Constitution of Louisiana, the10
treasurer shall pay into the fund each fiscal year an amount equal to the proceeds11
provided in Subsection A of this Section in an amount which is sufficient to bring12
the balance in the fund to one ten million dollars. The balance of the fund shall not13
exceed one ten million dollars. Any proceeds remaining after making the deposit14
into the fund shall be deposited into the state general fund.15

Section 2. This Act shall become effective on July 1, 2010; if vetoed by the governor17
and subsequently approved by the legislature, this Act shall become effective on July 1,18

Abstract: Increase the maximum fund balance for the Dept. of Justice Legal Support Fund
from $1 million to $10 million.
Present law establishes the Dept. of Justice Legal Support Fund (the fund) to be comprised
of a portion of proceeds recovered by the attorney general on behalf of the state including
court judgments, settlements, fines, fees, forfeitures, and penalties. Provides that monies in
the fund shall be used solely for defraying the costs of expert witnesses, consultants, contract
legal counsel, technology, specialized employee training and education, and public education
initiatives.
Present law provides that the fund balance shall not exceed $1 million.
Proposed law increases the maximum fund balance from $1 million to $10 million.
Effective July 1, 2010.
