Regular Session, 2010 HOUSE BILL NO. 1075 BY REPRESENTATIVE FANNIN STATE AGENCIES: Requires each state agency to provide the division of administration with information on certain types of contracts AN ACT1 To enact R.S. 49:200.2, relative to state administration, to require all state agencies to2 submit certain information to the division of administration for placement on a3 website reporting contractual information; to require state agencies to cooperate with4 the division of administration for the development of the website; to provide for5 rulemaking; and to provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 49:200.2 is hereby enacted to read as follows:8 ยง200.2. State agencies; contractual information9 A. Each state agency, whether or not such state agency has statutory or10 delegated authority to process its own contracts, shall provide the division of11 administration, in a form and manner prescribed by the division, information on12 professional service, consulting service, and social service contracts as defined by13 R.S. 39:1484. The division of administration shall post such information on a14 contract financial management system website developed by the division. For the15 purposes of this Section, "state agency" means any board, commission, department,16 division, agency, or other entity within the executive branch of state government.17 B. Present law (R.S. 39:6(C)) requires the commissioner of administration to establish and maintain a website to post reports of state spending and specifies information to be included on such website. Requires the commissioner of administration to consult with the Joint Legislative Committee on the Budget in the development of the specifications for the database used for the website. Proposed law retains present law and further requires each state agency, whether or not such state agency has statutory or delegated authority to process its own contracts, to provide the division of administration (the division), in a form and manner prescribed by the division, information on professional service, consulting service, and social service contracts. Requires the division to post such information on a contract financial management system website developed by the division. Defines "state agency" as any board, commission, department, division, agency, or other entity within the executive branch of state government. Proposed law requires the division to promulgate rules in accordance with the APA to implement proposed law, including requirements governing the information and timing of submission of information to the division.
