Regular Session, 2010 HOUSE BILL NO. 1125 BY REPRESENTATIVE WILLIAMS MTR VEHICLE/LICEN PLATES: Creates the "Share the Road" prestige license plate AN ACT1 To enact R.S. 32:202 and R.S. 47:463.141, relative to special prestige license plates; to2 provide for the creation and issuance of the "Share the Road" license plate; to3 provide for fees and distribution of fees; to provide for the promulgation of rules and4 regulations; to create the Louisiana Bicycle and Pedestrian Safety Fund; and to5 provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 32:202 is hereby enacted to read as follows: 8 §202. Louisiana Bicycle and Pedestrian Safety Fund9 A. There is hereby created, as a special fund in the state treasury, the10 Louisiana Bicycle and Pedestrian Safety Fund, hereinafter referred to as the "fund".11 The source of monies for the fund shall be a portion of the monies derived from fees12 imposed pursuant to the provisions of R.S. 47:463.141 grants, gifts, and donations13 and any other monies received by the state for the purposes of bicycle and pedestrian14 safety.15 B. After compliance with the requirements of Article VII, Section 9(B) of16 the Constitution of Louisiana, relative to the Bond Security and Redemption Fund,17 an amount equal to that deposited into the state treasury from the foregoing sources18 shall be deposited in and credited to the fund. The monies in the fund shall be19 invested by the treasurer in the same manner as the state general fund, and interest20 earnings shall be deposited into the fund. C. Monies in the fund shall be subject to annual appropriation by the1 legislature for use by the Department of Transportation and Development or the2 governing authority. The monies in the fund shall be allocated and disbursed by the3 secretary of the Department of Transportation and Development or the governing4 authority and used solely for bicycle and pedestrian safety.5 Section 2. R.S. 47:463.141 is hereby enacted to read as follows:6 `§463.141. Special prestige license plate; "Share the Road"7 A. The secretary of the Department of Public Safety and Corrections shall8 establish a special prestige motor vehicle license plate to be known as the "Share the9 Road" plate, provided there is a minimum of one thousand applicants for such plates.10 These license plates shall be restricted to use on passenger cars, pickup trucks,11 recreational vehicles, and vans.12 B. The special prestige license plate shall be known as the "Share the Road"13 license plate and shall bear the likeness of a person on a bicycle riding on the road14 and a pedestrian walking centered on the left side of the licence plate. The15 "Louisiana" name logo shall be at the top of the plate. The center of the plate shall16 display a number, with the first issued plate displaying the number one and shall17 continue in consecutive numerical order for each plate. Centered at the bottom of the18 plate below the number shall be the words "Share the Road".19 C. The prestige license plate shall be issued, upon application, to any citizen20 of Louisiana.21 D. The department shall collect the following fees for this license plate:22 (1) An initial fee of twenty-five dollars, which shall be disbursed in23 accordance with Subsection E of this Section.24 (2) A handling fee of three dollars and fifty cents to be retained by the25 department to offset a portion of administrative costs.26 (3) A renewal fee, which shall be the same as the fee for renewing a regular27 motor vehicle license plate.28 HLS 10RS-1744 ENGROSSED HB NO. 1125 Page 3 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. E. The monies received from the additional twenty-five-dollar fee shall be1 deposited into the Louisiana Bicycle and Pedestrian Safety Fund, R.S. 32:202, for2 use by the Department of Transportation and Development for the sole purpose of3 promoting bicycle and pedestrian safety.4 F. A handling fee of $3.50 to be retained by the department to offset a portion of administrative costs. A renewal fee which shall be the same as the fee for renewing a regular motor vehicle license plate. Proposed law provides that the secretary shall adopt rules and regulations to implement the provisions provided in proposed law.
