HOUSE BILL NO. 1125

AN ACT1
To enact R.S. 32:202 and R.S. 47:463.141, relative to special prestige license plates; to2
provide for the creation and issuance of the "Share the Road" license plate; to3
provide for fees and distribution of fees; to provide for the promulgation of rules and4
regulations; to create the Louisiana Bicycle and Pedestrian Safety Fund; and to5
provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 32:202 is hereby enacted to read as follows: 8
§202.  Louisiana Bicycle and Pedestrian Safety Fund9
A. There is hereby created, as a special fund in the state treasury, the10
Louisiana Bicycle and Pedestrian Safety Fund, hereinafter referred to as the "fund".11
The source of monies for the fund shall be that portion of the monies derived from12
fees imposed and dedicated to the fund pursuant to the provisions of R.S.13
47:463.141, and grants, gifts, and donations and any other monies received by the14
state for the purposes of bicycle and pedestrian safety and which are appropriated to15
the fund.16
B. After compliance with the requirements of Article VII, Section 9(B) of17
the Constitution of Louisiana, relative to the Bond Security and Redemption Fund,18
an amount equal to that deposited into the state treasury from the foregoing sources19
shall be deposited in and credited to the fund.  The monies in the fund shall be20
invested by the treasurer in the same manner as the state general fund, and interest21
earnings shall be deposited into the fund. All unexpended and unencumbered22
monies remaining in the fund at the end of each fiscal year shall remain in the fund.23
C. Monies in the fund shall be subject to annual appropriation by the24
legislature for use by the Department of Transportation and Development.  The25 ENROLLEDHB NO. 1125

monies in the fund shall be allocated and disbursed by the secretary of the1
Department of Transportation and Development and used solely for bicycle and2
pedestrian safety.3
Section 2.  R.S. 47:463.141 is hereby enacted to read as follows:4
`§463.141.  Special prestige license plate; "Share the Road"5
A. The secretary of the Department of Public Safety and Corrections shall6
establish a special prestige motor vehicle license plate to be known as the "Share the7
Road" plate, provided there is a minimum of one thousand applicants for such plates.8
These license plates shall be restricted to use on passenger cars, pickup trucks,9
recreational vehicles, and vans.10
B. The special prestige license plate shall be known as the "Share the Road"11
license plate and shall bear the likeness of a person on a bicycle riding on the road12
and a pedestrian walking centered on the left side of the licence plate.  The13
"Louisiana" name logo shall be at the top of the plate.  The center of the plate shall14
display a number, with the first issued plate displaying the number one and shall15
continue in consecutive numerical order for each plate. Centered at the bottom of the16
plate below the number shall be the words "Share the Road".17
C. The prestige license plate shall be issued, upon application, to any citizen18
of Louisiana.19
D.  The department shall collect the following fees for this license plate:20
(1) An initial fee of twenty-five dollars, which shall be disbursed in21
accordance with Subsection E of this Section.22
(2) A handling fee of three dollars and fifty cents to be retained by the23
department to offset a portion of administrative costs.24
(3) The standard motor vehicle license tax imposed by Article VII, Section25
5 of the Constitution of Louisiana.26
E. The monies received from the additional twenty-five-dollar fee shall be27
deposited into the Louisiana Bicycle and Pedestrian Safety Fund, R.S. 32:202, for28
use by the Department of Transportation and Development for the sole purpose of29
promoting bicycle and pedestrian safety.30 ENROLLEDHB NO. 1125

F. The secretary shall adopt rules and regulations as are necessary to1
implement the provisions of this Section.2
