Regular Session, 2010 HOUSE BILL NO. 1139 BY REPRESENTATIVE GREENE MTR VEHICLE/LICEN PLATES: Provides for amendments to the Rotary 6200 special prestige license plate provisions AN ACT1 To amend and reenact R.S. 47:463.102, relative to the Rotary District 6200 special prestige2 license plate; to provide for the name; to provide for eligibility; to provide for3 distribution and use of royalty fees; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 47:463.102 is hereby amended and reenacted to read as follows:6 ยง463.102. Special prestige license plates; Louisiana Rotary District 62007 A. The secretary of the Department of Public Safety and Corrections shall8 establish a special prestige license plate, to be known as the Louisiana Rotary9 District 6200, hereafter referred to as the "organization", plate, subject to the10 provisions of this Section. The license plate shall be restricted to passenger cars,11 pickup trucks, vans, and recreational vehicles. The color and design of the license12 plate shall be selected by Rotary District 6200 the organization. The license plate13 shall contain the organization's logo, provided it is in compliance with R.S.14 47:463(A)(3), and shall bear the words "SERVICE ABOVE SELF".15 B. The license plate shall be issued, upon application, to any member in16 good standing of the organization citizen of Louisiana in the same manner as any17 other motor vehicle license plate and as provided for in this Section.18 C. A one-time royalty fee of twenty-five dollars for use of the organization's19 logo shall be collected from the applicant and forwarded to the organization the20 Rotary District 6200 Foundation, for each license plate issued and renewed as21 provided in this Section, and shall be accompanied by identification of the parish in22 HLS 10RS-1409 ENGROSSED HB NO. 1139 Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. which the applicant is domiciled. The department shall also collect the standard1 motor vehicle registration license fee provided for in R.S. 47:463 and a handling fee2 of three dollars and fifty cents. The handling fee shall be retained by the department3 to offset a portion of administrative costs.4 D. The monies received from the royalty fees by the organization foundation,5 shall be used solely for charitable purposes for residents of the state of Louisiana and6 shall be distributed to the Rotary district in the parish of the applicant's domicile, as7 reported to the foundation by the department. The organization foundation shall be8 responsible for establishing and disbursing the funds for charitable purposes.9 E. The secretary shall establish a prestige license plate for the organization10 in accordance with the provisions of this Section when all of the following11 conditions are met:12 (1) All necessary contracts regarding use of the organization's logo have13 been executed.14 (2) The secretary has received a minimum of one thousand applications for15 the license plate.16 F. The secretary shall establish rules and regulations as are necessary to17 implement the provisions of this Section, including but not limited to rules and18 regulations governing the collection and disbursement of royalty fees, verification19 that an applicant is a member of the organization, the transfer and disposition of such20 license plates, the colors available, and the design criteria.21 DIGEST The digest printed below was prepared by House Legislative Services. Proposed law changes the name of the plate to the "La. Rotary" license plate. Present law provides that the license plate shall be issued, upon application, to any member in good standing of the organization. Proposed law provides that the license plate shall be issued to any citizen of La. in the same manner as any other motor vehicle license plate and as provided for in present law. Present law provides for the royalty fee to be forwarded to the organization for each issued license plate. Proposed law provides for the royalty fee to be forwarded to the Rotary District 6200 Foundation to be accompanied by identification of the parish in which the license plate was issued or renewed and to be distributed to the parish where the applicant is domiciled. (Amends R.S. 47:463.102) Summary of Amendments Adopted by House Committee Amendments Proposed by House Committee on Transportation, Highways and Public Works to the original bill. 1. Changed the information forwarded to the foundation for identification from city to parish in which the applicant is domiciled. 2. Changed the location for the distribution of collected royalty fees from the rotary district in which the city of issuance or renewal of the license plate is situated to the parish of the applicant's domicile.
