ACT No. 847 Regular Session, 2010 HOUSE BILL NO. 1277 (Substitute for House Bill No. 53 by Representative Roy) BY REPRESENTATIVE ROY AND SENATOR MCPHERSON AN ACT1 To enact R.S. 32:387.9.1 and 387.19, relative to special permits; to authorize vehicles2 hauling agronomic or horticultural crops by special permit to travel upon a segment3 of Interstate 49 as an alternate route to US 71 and US 167; to authorize issuance of4 special permits for one-way hauls of bagged rice for export within a sixty-mile radius5 of the Port of Lake Charles; to authorize the Department of Transportation and6 Development to promulgate rules and regulations; to provide for limitations; and to7 provide for related matters.8 Be it enacted by the Legislature of Louisiana:9 Section 1. R.S. 32:387.9.1 and 387.19 are hereby enacted to read as follows:10 §387.9.1. Special permits; vehicles hauling agronomic or horticultural crops;11 authorization to travel upon segment of Interstate 49 as alternate route to US12 71 and US 16713 Notwithstanding any other provision of law to the contrary, and provided the14 federal government does not raise any objection to such permitted weight limit, any15 vehicle issued an annual special permit pursuant to the provisions of R.S. 32:387.916 may travel upon that segment of Interstate 49 between its interchange with US 7117 and US 167 (MacArthur Drive) south of the city of Alexandria and its interchange18 with Rapides Station Road north of the city of Alexandria as an alternate route to US19 71 and US 167.20 §387.19. Special permit; bagged rice for export; rules and regulations; Port of Lake21 Charles22 A. These special permits shall be1 issued at the truck permit office of the Department of Transportation and2 Development.3 (1) The permit shall be issued at the truck permit office of the Department of4 Transportation and Development.5 (2) The fee for the permit shall be five hundred dollars annually.6 (3) The permit may authorize the operation of a vehicle or combination of7 vehicles with a total gross vehicle weight not to exceed ninety-five thousand pounds.8 No tandem axle set equipped with low pressure pneumatic tires shall exceed thirty-9 four thousand pounds on the interstate system or thirty-seven thousand pounds off10 the interstate system. No tridum axle set equipped with low pressure pneumatic11 tires shall exceed forty-two thousand pounds on the interstate system or forty-five12 thousand pounds off the interstate system.13 (4) The secretary may impose a civil penalty of up to five cents per pound14 for each violation of the weight limit established by this Section.15 (B) The secretary may promulgate rules and regulations in accordance with16 the Administrative Procedure Act as are necessary to enforce the provision of this17 Section.18 Section 2.
