Regular Session, 2010 HOUSE BILL NO. 1278 (Substitute for House Bill No. 575 by Representative Baldone) BY REPRESENTATIVE BALDONE ENVIRONMENT/RECYCLING: Authorizes the delivery of certain scrap materials to scrap metal collection and recycling facilities AN ACT1 To amend and reenact R.S. 30:2419(A)(2) and (3), relative to scrap metal recycling; to2 authorize the delivery of scrap metal containing fuel tanks to a scrap metal collection3 and recycling facility; to delete the requirement that persons delivering scrap to these4 facilities certify that fuel tanks have been removed; and to provide for related5 matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 30:2419(A)(2) and (3) are hereby amended and reenacted to read as8 follows: 9 ยง2419. Control Law, R.S. 30:2101 et seq., and regulations promulgated pursuant thereto,1 fuel tanks if not certified as gas-free, or refrigerants containing chlorofluorocarbons2 (CFC's).3 (3) Any person delivering any scrap, including but not limited to4 automobiles or automotive parts, to a scrap metal collection and recycling facility5 must submit to the scrap metal collection and recycling facility a certification signed6 by a duly authorized representative that all lead-acid or nickel cadmium batteries,7 microwave ovens, fluorescent lights, capacitors exceeding one inch in length, width,8 or height, hazardous waste as defined by the Louisiana Environmental Quality Act,9 R.S. 30:2001 et seq., radioactive materials regulated by the Louisiana Nuclear10 Energy and Radiation Control Law, R.S. 30:2101 et seq., and regulations11 promulgated pursuant thereto, fuel tanks if not certified as gas-free, or refrigerants12 containing chlorofluorocarbons (CFC's) have been removed from and are not13 included with the scrap delivered.14 * * *15 DIGEST The digest printed below was prepared by House Legislative Services. Proposed law retains present law but deletes the prohibition against the intentional delivery of scrap to a scrap metal collection and recycling facility if the scrap contains fuel tanks not certified as gas-free. Proposed law retains present law but deletes the requirement that persons delivering scrap to a scrap metal collection and recycling facility submit to the facility a certification signed by a duly authorized representative that fuel tanks not certified as gas-free have been removed.
