AN ACT1
To amend and reenact R.S. 30:2419(A)(2) and (3), relative to scrap metal recycling; to2
authorize the delivery of scrap metal containing fuel tanks to a scrap metal collection3
and recycling facility; to delete the requirement that persons delivering scrap to these4
facilities certify that fuel tanks have been removed; and to provide for related5
matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 30:2419(A)(2) and (3) are hereby amended and reenacted to read as8
follows: 9
ยง2419. Lead acid batteries; land disposal prohibition; scrap and scrap metal10
recycling, prohibited items11

(2) No person may knowingly and intentionally deliver scrap to a scrap14
metal collection and recycling facility authorized under the laws of this state if such15
scrap contains any lead-acid or nickel cadmium battery, microwave oven, fluorescent16
light, capacitors exceeding one inch in length, width, or height, hazardous waste as17
defined by the Louisiana Environmental Quality Act, R.S. 30:2001 et seq.,18
radioactive materials regulated by the Louisiana Nuclear Energy and Radiation19
Control Law, R.S. 30:2101 et seq., and regulations promulgated pursuant thereto,20
fuel tanks if not certified as gas-free, or refrigerants containing chlorofluorocarbons21
(CFC's).22
(3) Any person delivering any scrap, including but not limited to23

must submit to the scrap metal collection and recycling facility a certification signed1
by a duly authorized representative that all lead-acid or nickel cadmium batteries,2
microwave ovens, fluorescent lights, capacitors exceeding one inch in length, width,3
or height, hazardous waste as defined by the Louisiana Environmental Quality Act,4
R.S. 30:2001 et seq., radioactive materials regulated by the Louisiana Nuclear5
Energy and Radiation Control Law, R.S. 30:2101 et seq., and regulations6
promulgated pursuant thereto, fuel tanks if not certified as gas-free, or refrigerants7
containing chlorofluorocarbons (CFC's) have been removed from and are not8
included with the scrap delivered.9
